No but if he GRANTS a mistrial they can certainly try for an easier judge.

I didn’t think that would happen given that Judge Ellis seemed pretty antagonistic to the prosecutors and I was thinking they would request the mistrial based on the Jury instructions and Judge Ellis’ comments they were complaining about.
