I think their confidence is due to the fact that they have acted with impunity for so long. They use the typical legal stall, sometimes running out the statute of limitations. But even worse, right now, is the tactic of redistricting congressional districts (this may be one of the projects O and his team are working on). Along with flooding the electorate with as many non-citizens as possible.
They believe they will return to power and just need to stall until the mid-term elections.
This is why further exposure is key.

It's interesting, since both Q and the DS have had (at first) superficially similar strategies: selective winks and nudges to get their base riled up.
