What if he came upon a kidnap and rape? Would he still be charged?

Seems to me it only became crime when it was discovered nothing nefarious was going on.

Then again, I’m suspicious that he set his wife up with a trackable ipad.

The legal precedent is the couple who videoed a planned parenthood executive discussing chopping up babies and selling the parts, complete with the prices.

THEY are going to jail.

The planned parenthood executive and planned parenthood get no further investigation nor charges.

The land of the freak, and the home of the knave.

That’s a default setting for Apple devices. Very handy when a device is misplaced. I use it several times per year (as a developer & aficionado, I have ~11 such devices). Nothing “suspicious” about enabling tracking, and people tend to keep such personal devices handy at all times.

And yeah, maybe he did deliberately wonder about her location. So what? apparently his suspicions proved correct, and he has a right to know she’s cheating.

I’d go so far as suggest that since she vowed (directly or implicitly) to remain monogamous to him, he could construe the act as suspicion & discovery of statutory rape.
