I'm not saying such a merger can't be done, just I doubt it has been. On review of some of the statutory bases for CIA and NSA, it appears to me that DNI has the power to make the sort of org-chart rearrangement that is speculated to have occurred. DNI can also clip CIA directly, without changing the org-chart.
US Code Title 50 includes substantial legislation on the Intelligence Community in general, and CIA (Chapter 46) and NSA (Chapter 47) in particular.
DNI has the organizational power (See 50 USC 3024). As I read that, I sense Congress trying to micromanage something it is not competent to even manage at all. Thank God we don't get all the government we pay for.
Anyway, by 50 USC 3035, the CIA serves the DNI, and has powers and limitations according to 50 USC 3036.
