Hours later, Anna and her mother went to a hospital, where Anna told nurses two detectives had sexually assaulted her, according to hospital records. Semen collected in Annas rape kit matched the DNA of detectives Eddie Martins, 37, and Richard Hall, 33, of the Brooklyn South narcotics unit. Both have since resigned from the force and been charged with rape.
But Anna didnt know that in New York, there is no law specifically stating that it is illegal for police officers or sheriffs deputies in the field to have sex with someone in their custody. It is one of 35 states where armed law enforcement officers can evade sexual assault charges by claiming that such an encounter from groping to intercourse was consensual.

The truth is most LEO’s today are primarily revenue collection agents for the state. They don’t deserve any special respect over what toll booth operators get.

You are right. After my earlier comments Yo-Yo caught up with me and got me to read the full account. These accessories to having weed in the car with her did not come back to defend her. No one but the three knows for sure what happened that somehow there was no arrest documented for the unlawful hokeysmokey. Maybe the other ones will shy away from the whole thing, eh? Is that why they were not kept at the scene? More to it than either of us know.

Because the police can, before committing the actual rape, legally force their victim into a situation where there can be no other witnesses or documentation of the crime that might make the “consensual” defense difficult.
For example, in this case, if an ordinary non-police rapist had forced this vehicle off the road, then restrained and abducted the girl and dragged her into a van, the “consensual” defense would already be negated by those acts. When the police do it, they are able to claim these actions were simply part of their job, and yet they still accomplish the goal of getting the potential victim into a controlled situation where nobody else can witness any further acts.

Well, it’s simple to prove if there are witnesses, security cameras, etc. In the case of a police officer, the same events documented by witnesses or other evidence prove nothing.

I have a buddy that is a fire chief - he said they had a bunch of arson fires - started off small and got bigger each time. Turns out it was one of the new guys on the force lighting them! “Yeah - it’s sort of weird, but a lot of arsonists join fire departments so they can be around fire. Plus, he’s a volunteer, so he got $10 each call!”
Many worker's comp insurers regard a claimant's volunteer firefighter status as a flag that needs to be cleared in a claim. It's not unheard of for a volunteer firefighter to sustain an injury responding to a call, and then claim to have sustained an injury at his day job.
Once again, my objection is not to outlawing the act between an officer and his/her detainee, it is with the headline of the article that suggests that there is some law that protects officers who have sex with detainees. Clearly, no such law exists.
Ha, ha, well, they like to think that. There are some funny pics on the internet of firefighters and police playing pranks on one another. One of my favorites, was done by firefighters and it’s a giant box held up by a stick with a rope attached and inside are some donuts.

Actually, one of my sons was and is still in law enforcement but no longer a street cop. He is a Christian, he is honest to a fault, he hates crooked cops, and he saw things that most people couldn’t stomach. He was lied to, threatened, and physically attacked on more than one occasion. So do I defend the police whenever their reputation is besmirched? Absolutely.
Most people could not deal with what cops have to deal with on a daily basis.
