Russia probe lawyers think Mueller could indict Trump

Special counsel Robert Mueller’s Russia investigation has gathered enough steam that some lawyers representing key Donald Trump associates are considering the possibility of a historic first: an indictment against a sitting president.

While many legal experts contend that Mueller lacks the standing to bring criminal charges against Trump, at least two attorneys working with clients swept up in the Russia probe told POLITICO they consider it possible that Mueller could indict the president for obstruction of justice.

Neither attorney claimed to have specific knowledge of Mueller’s plans. Both based their opinions on their understanding of the law; one also cited his interactions with the special counsel’s team, whose interviews have recently examined whether Trump tried to derail the probe into his campaign’s Russia ties.

“If I were a betting man, I’d bet against the president,” said one of the lawyers.

The second attorney, who represents a senior Trump official, speculated that Mueller could try to bring an indictment against Trump even if he expects the move to draw fierce procedural challenges from the president’s lawyers – if only to demonstrate the gravity of his findings.

“It’s entirely possible that Mueller may go that route on the theory that, as an open question, it should be for the courts to decide,” the attorney said. “Even if the indictment is dismissed, it puts maximum pressure on Congress to treat this with the independence and intellectual honesty that it will never, ever get."

Sure, of course Mueller could TRY to accuse and indict Trump of obstruction of justice. He’s a deep state war-horse, brought out of retirement for one final kamikaze mission.

As we have seen, Obstruction is a very nebulous concept, it can be thrown around easily. Mueller doesn’t even have to prove anything. Only the accusation with give the media and the Left the talking points they need for the next 12 months.

I’m sure Trump is holding a “Trump Card”

Hell fire and fury will unleash if this happens as Trump will take it directly to the people with Tweets.

I’m sure Trump knows a lot more than he is sharing with the public.

I tried to post this a few hours ago and got "blocked" because FR insisted it go under "bloggers." Fine by me.

I think the article is useful just to identify an angle of attack that the #fakenews is going to advance. The content of the article is pure garbage.

One more thought. The press is throwing up tones of BS in order to take some of the oxygen out of the room. All time spent debating the most asinine contentions is time not spent on legitimate debate.

He can’t traditionally and according to the Constitution, because all a president’s political enemies would have to do is create a crime with false witnesses and get him out of office. But this may be the last ditch, go-for-broke, hail mary pass strategy of Mueller when the heat is turned up on his sorry ass.

Yeah, I learned my lesson too. I rarely post articles, but it sucks doing the work and getting the “No thanks” at the end. I have better things to do, and FR is no worse off if I don’t post articles.

I think it all depends on exactly how ‘independent’ and neutral about Trump as President that Mueller is.

The normal course of action in this type of case would be for the independent counsel to turn over the information to the Congress for an impeachment action. That is how the Constitution handles high crimes and misdemeanors of the President.

But suppose Mueller isn’t neutral and wants to take his best shot at removing the President. Maybe he waits until after the mid-term elections and counts the votes. If the Dems don’t get enough Representatives elected to swing the majority to them, then the likelihood of an impeachment by a Republican majority is slim.

If he is really an anti-Trumper in the costume of an independent he could get a grand jury to indict the President for whatever crime he wanted to charge him with, regardless of the civil unrest that would ensue.

These are the times that try President Trump.

As “special counsel,” Mueller has no authority to indict the President of the United States.

Mueller has the authority to present his findings to Rosenstein and that’s about it.

The only mechanism is impeachment, which has to happen in the House. Fat chance.

After the FISA memo comes out, and the collaborating documents that follow, Rosenstein and Mueller will be neutered anyway.

The Founding Fathers knew they had to make it difficult to remove a president. Otherwise ANYONE could file charges and there’d be a new president every 30 days.

However, don’t think they won’t try. They will do everything they can, including murder, to protect Obama.

If the memo shows people broke the law, who will charge them and who will arrest them?

If it shows Mueller in the memo Trump would have reason to fire him. But shouldn’t he be arrested and tried?
