That is the purview of the judicial branch, not some tribunal. And the oath is to “ defend the Constitution of the United States against all enemies, foreign and domestic.” Not to defend us . The one real thing that we share is that Constitution. No other nation has a document that unites the people in ordered Liberty. Their documents concern the operations of the state not the Liberties of the People. Military tribunals whomever their target, whatever the crime are an affront to the Liberty of the People and an assault on the Constitution.

It seems like a lot of semantics in your post. Our government is way past Constitutional now as it is. The judicial branch is very corrupted so there really is no way we can save our Constitutional Republic through them. I don’t trust them, do you??? That’s basically what you are telling us is to trust a corrupt judicial system but they are a huge part of the problem.

If this was normal times I don’t believe any Constitutional conservative would care to go the military tribunal route but these are not normal times and our government is very, very corrupt to the point it is not going to police itself and the last 100 years proves they have NOT.

Go back and check the first seven words of the Constitution.
