There may be three important things in play:
1. Will the evidence show how close to the shooter was the victim when shot? (i.e., reportedly, 2-3 feet?)
2. It appears the shooter was CCW. Will this be negated by any state conditions?
3. Will the jury that decides this case be "balanced"?

Probably. Remember, the shooter went to his vehicle to retrieve his gun. Then, he approached the other driver. That’s escalation, clearly not allowed under the law.

“2. It appears the shooter was CCW. Will this be negated by any state conditions?”

Again, the shooter escalated the situation, instead of evading trouble. The law is clear and taught in all reputable carry courses.

“3. Will the jury that decides this case be “balanced”?”

Your guess is as good as mine on this one.

Other than foolishly escalating the situation, what was the BIGGEST mistake this shooter made?
