Still sounds like a righteous shoot to me. He should have popped the loudmouthed passenger too.

Probably. Remember, the shooter went to his vehicle to retrieve his gun. Then, he approached the other driver. That’s escalation, clearly not allowed under the law.
“2. It appears the shooter was CCW. Will this be negated by any state conditions?”
Again, the shooter escalated the situation, instead of evading trouble. The law is clear and taught in all reputable carry courses.
“3. Will the jury that decides this case be “balanced”?”
Your guess is as good as mine on this one.

Other than foolishly escalating the situation, what was the BIGGEST mistake this shooter made?
Then, he approached the other driver. Thats escalation, clearly not allowed under the law.
It is not at all clear the shooter physically confronted the victim or even approached the victim; in fact, a witness who accompanied the victim stated:
Rahim got very close to Weiss.
Depending on how the facts get sorted out and presented to the jury, the shooter may not have confronted (escalation), there may not be any state-imposed duty for the shooter to avoid any contact with the victim (de-escalation)(by running or by remaining in his auto), and there may not be any violation of the shooters CCW.
Much will be made of the seemingly most objective passing drivers version. Her angle of vision will be examined (did she have a good view of and actually see all four hands at all times, etc.) along with whether she had stopped driving and was entirely focused on the incident, just to name a few.
