Tribune-Herald staff writer Tommy Witherspoon is live-tweeting from inside the courtroom in the trial of Jacob Carrizal, the first biker to be prosecuted for his alleged role in the May 17, 2015, Twin Peaks shootout.

Jury selection is underway, and opening statements are expected to be given this afternoon.

Nine people were killed and dozens injured in the melee between rival biker groups the Bandidos and Cossacks.

The judge and attorneys are talking to prospective jurors individually now. These are the ones who asked not to speak publicly about issues.

The judge is talking to the parties in chambers. They might begin calling in potential jurors who didn't want to talk about issues in public

Her last question: "Will each of you promise to give Jake Carrizal the fair trial he deserves and has been waiting so long to get?"

Gotro is asking each of the 145 or so on the panel if they will follow the law.

Gotro said a jury is allowed to disregard evidence if it finds the evidence was illegally obtained.

Gotro is asking the panel about items searched and seized without probable cause.

The gun discussion is ongoing. Gotro has really got the panel talking now, with comments on all sides of the issue.

Many say there are too many guns but they aren't comfortable with the government seizing guns from lawful owners.

Now she's got the panel in a 2nd Amendment discussion, asking if there are too many guns and if they fear the government will take them.

Gotro is saying that "technicalities" that people often chide defense attorneys for exploiting are actually important constitutional rights.

Gotro asked why someone would lie to a police officer.

Gotro is talking about the unreliability of eyewitness testimony and reasons why it can be flawed. One juror said Twin Peaks served alcohol.

Gotro is warning jurors against what she called confirmation bias, having formed an opinion and only listening to evidence that supports it.

She is asking if witnesses, including police officers, always tell the truth. One juror said it is unlikely a police officer would lie

Gotro is picking up her voir dire where she left off Tuesday evening. She is asking why defendants might not take the stand.

The parties have agreed to proceed without the missing juror, but the judge ordered deputies to continue looking for him to execute the writ

The judge told the panel that we can't proceed at this time and recessed the proceedings actually before they started.

The judge issued a writ of attachment for a no-show juror and the judge is recessing the panel until he is located.

Stay tuned. There is never a dull moment around here and you never know what is going to happen next. But you can bet it won't be ordinary.

The jury panel is coming in now and defense attorney Casie Gotro will continue her voir dire examination of the panel.

Uh-huh. That's about what they told us. Said I'd be crying.

Why I would be, other than over possible miscarriage(s) of justice -- some of which have already occurred under rulings made by Judge Johnson in Clendennen's case BECAUSE they were made by Judge Johnson (who was previously to himself elected as Judge, law-form partner with DA Reyna) is less than clear, the various and shifting reason that were supplied inadequate explanation for variety of reasons.

You said that word "motions". There are other Motions still pending resolution.

Reyna deftly side-stepped one aimed at dragging his own and McLennan County's "ways" into the criminal proceedings. It was enough to have Reyna come up with a crafty dodge excuse reason for himself requesting be recused from prosecuting Clendennen. It was artful, I'll give the man that much. The guy is cunning, and not to be underestimated despite recent erosion of his own personal credibility.

On another note:
Where's the (legal-beagle community) folks who were so miffed-off about the previous gag order?

Judge Shaver (who did not form the previous) got a freebie on this latest one, that a couple of weeks or so ago came from his bench?

Now that a little pressure is off -- I think that should be examined. Justified? Is it? On what grounds? Could that be told to us, just a little, even? Shaver owes the world (citizens of the State of Texas, and of the United States) explanation -- now that Reyna the Facebook self-defending prosecutor is off one case, at least.

And speaking of Motions, I was aiming to get around to; what about the other defendants who's legal representatives 'flooded' the courthouse with requests Reyna be recused (or a Judge to order Reyna removed from role of prosecutor) the same for their clients as was done in instance of defendant Clendennen? If that doesn't happen --- and Reyna remains prosecutor, at the least the trials could not be put before Judge Johnson (whom I bear no ill towards) as judge.

So you are not really against crime at all, just against anyone pointing out that cops can be criminal too? You would have to every bit of that and nothing but (no exceptions allowed) if the reasoning you employed to reach such verdict pronounced against myself [italicized above] were to be applied in the same ways to yourself, and your own motivations. Am I speaking over your head again, Princess? It seems to me that I near always am. You never seem to "get" it.

The shoe fits ~you~ rather well (even if it's sloppy loose in some places, and too pinchingly tight in other -- it is your "style") but the one you selected and "hit send" sent to me, does not fit me at all -- and yet further is simply not representative of footwear suitable for the paths which I travel --- as most any who have been reading thru the sort of conversations you and I have had on this forum for the last two years I've no doubt would have been able to ascertain by now. Love me, or hate me -- whichever one of those, none here (other than yourself, and perhaps a few other lying swine) would ever dare say such things about myself.

How many are murderers, Princess? All 177 who were arrested and had $1,000,000 (one million dollar) bails set over them to "send a message" as Pete Peterson said was the reason?

Or is it that only 155 who were eventually identically indicted ("identically" save for the late adjustment to indictment in instance of Carrizal) are as you say -- murderers?

Perhaps some lesser number could reasonably enough be guilty of murder?

Now we're getting somewhere...

Who should Reyna bring to trial next? --Carrizal, again?

What would you recommend that the McLennan County DA's office do? I would think that first they should determine who they may have standing for to bring to trial. It cannot be Clendennen. How many others have the DA's Office been prohibited from prosecuting (due to Reyna's request that he be recused)?
