Wear a Pepsi shirt while delivering Coke products and see how long you have a job.

Free speech does not mean consequence-free speech.

The problem is the owners are afraid to not look Progressive by punishing the players for this nonsense. So they hide behind free speech

It’s neither here, nor there, as to whether they’re allowed “free speech”, however, it only means the government can’t do anything about it.

It DOESN’T mean that we, the people, can’t totally reject the NFL, and never buy another ticket, or a sponsor’s product.

THAT will nullify their “free speech rights” a lot faster than the Government...and they’ll be too broke to fight it.

Do NFL Players Have Right of Free Speech? No!

Thanks for that Kevin, the First Amendment restrains the Government and it's agents, not private individuals.

“Unless the player has a contract granting that right...”
I have to think there’s some contractual impediment to punishing the players.
Also, obviously, top talent cannot be replaced without affecting team play.

So the players are just going to have to grow up. Not easy for spoiled athletes to do.

I wish the media had a Monty Pythonesque character who would stop memes whn they get “too silly”.

"fire someone for saying things the employer doesn't like whether those things are said during or outside of working hours"

Regardless of whether or not it's Constitutional, I believe we need to expand first amendment rights with regard to what people say outside of working hours.

So long as a person doesn't claim to be speaking as a representative of his company, and so long as the speech is protected (i.e. does not incite violence, etc.) then an individual should not have to worry about losing his/her job because of statements made outside work.

We are entering a time where companies are making claims over the entire lives of their employees. They are requiring their employees to behave in certain ways and abstain from certain activities supposedly because of health concerns. They are scouring employees' social media to see if those employees share the same worldview and the company purports to hold in their mission statements.

This frankly is Orwellian even if it is not being done by the government.

Saying that employees can go get a job elsewhere or go work for themselves if they want to speak their minds is no answer. The leftists that gained control of the academies and media decades ago now have control over the corporate boards and offices. There will soon be no place for conservatives to work if we dare speak our minds outside of work.

I'm amazed at how many people don't understand this.

Even some on the right don't get it.

But what's worse is the intentional obfuscation from the left.

They arrantly lie about the meaning of the First Amendment to advance their anti-liberty agenda. That's what we're seeing right now in the NFL anthem debate. It's frustrating to read their brazen lies about the First Amendment but it's heartening to see that the vast majority of NFL fans aren't buying it.

No. DUH!

Of course not. When we go to work for someone and they pay you there are requirements for the job including hygiene, sometimes a suit and tie, etc. etc. AND IF YOU REFUSE TO COMPLY, YOU ARE FIRED.

You are not allowed to stand up on your desk and throw obscenities at the owners, customers, or suppliers. Doing so will get you fired in a second.

Does it mean that you can't do that on the street corner? Maybe. Maybe not. Again, if he or she is representing the company and customer good will, then no and that is probably part of the employee agreement.

"I am an attorney."

With all due respect, then,...

"As the text makes clear, the Constitutional right of free speech only applies to government action."

You might want to reconsider and rewrite that.

"In private enterprise, there is no right to free speech. "

Yes, there is such a right.

"A private employer can absolutely fire someone for saying things the employer doesn't like whether those things are said during or outside of working hours."

I don't know, but many conservatives have been fired by left-leaning employers for having written conservative articles and papers. There are consequences outside of law for that, though. The marketplace can be a powerful persuader. The employee also has the right to speak or write about that employer in truth after being fired.

"There is no right of free speech other than that stated in the First Amendment and that is limited to acts of the government."

Words mean something. You wrote that only government has the right of free speech while taking action. Get an English handbook, maybe "Rules for Writers." Refer to it when writing something important. Pretty handy.

Consider getting a text on logic (philosophy) that include the "logical fallacies" defined and with examples. Indispensable for lawyers, in my opinion (even though I'm not a lawyer).

The word, or, means something as differentiated from the word, and, in statutes and constitutions. Analyze it. Abridged means diminished, reduced, shortened, cut off or something like that. It shall not be reduced.

I'm only an old bookworm but hope that will help.

As citizens, they have the right to free speech.
As employees, their contract stipulates standing as part of their performance, up to & including termination if they don’t.

I know what you’re saying, though.

“Congress shall make no law...abridging the freedom of speech, or of the press;...”

You’re saying that Congress can’t legally abridge freedom of speech, therefore others can violate freedom of speech. But that passage in the Constitution assumes the right to freedom of speech by saying that Congress can’t legally outlaw it. See? And read some of the declarations and letters of those who made the Constitution. Read about the events leading up to the First Amendment. That’s where it’s really at: the intent behind a law.

But yes, in most cases, employers can fire people they disagree with on political matters. It’s not like the employers are arresting and convicting their employees. They’re only discharging them from jobs. It would be wiser, though, for such employers to turn to the right themselves, give up their vices and stop hiring lefties. Too many employers have gone to libertine-ville. Their drug-addled, sexually confused employees look and act like sideshow freaks.

The Dallas Cowboys told players you cannot do anything pro-cop after the BLM murderer killed 5 cops in the city.
Players have been told nothing pro-9/11.
So yes, owners can say no BLM crap, either, or they can choose to tolerate this divisiveness.
And their audience has the right to watch something else.
Given that most people watch sports to relax or ignore daily life, the politicization means the audience will find another escapist activity than the NFL.
