Black men may have a legitimate reason to flee Boston police during investigatory or “Terry” stops, the Massachusetts Supreme Judicial Court ruled Tuesday.
The court found that systemic racism in the Boston Police Department may be considered in conjunction with a suspect’s decision to flee from police during a stop.
A Terry stop, named for the U.S. Supreme Court case which sanctioned the practice, refers to a brief detention and search of an individual due to reasonable suspicion of criminal conduct.
In this case, a black male named Jimmy Warren was arrested in 2011

Not always. I recall one time working the gang unit, I went to back up an officer who called out in a foot pursuit of a black male adult. I arrived in the area just in time to see the perp come racing from between two buildings and start running past my patrol car down the street. (This was about a quarter mile from the initial call) I dumped the car into park and jumped out just as the officer I was backing up raced past me too. Within another 100 feet he had tackled the perp and I hustled over to assist in cuffing him up. When we rolled him over, he started complaining that he never thought any white cop would catch him. Of course that white cop was a former Marine and a triathlete who routinely ran 8-10 miles a day. For my part I just informed the now winded perp that he could run fast, but not faster than a radio call...
This is insane. Totally insane.

“...Such an individual, when approached by the police, might just as easily be motivated by the desire to avoid the recurring indignity of being racially profiled as by the desire to hide criminal activity. Given this reality for black males in the city of Boston, a judge should, in appropriate cases, consider the report’s findings in weighing flight as a factor in the reasonable suspicion calculus.”
