If there was a way to use forensic psychiatry to make a case that he is mentally unfit for office, it would make history, which congress and no one is willing to do

so we keep thinking the USA can prevail over anything, for another 13 months

I believe that YES there is a constitutional way...

We The People have the constitutional authority, the duty to DEPOSE a tyrannical government, our founding documents the Declaration of Independence, the Constitution and the Bill of Rights are all about freedom from tyranny, and we don’t need congress or any other corrupt gov’t entity to do it, the precedent for such has been established, we the people fail to protect, defend and secure our Constitutional Free Republic.

Not an opinion it is a fact!

There would be the 25th amendment which would be triggered if potus found unfit for office .... but how do you find an official to be mentally unfit with the Congress we’ve got? [Pelosi and Reid?)

I post this scenario every now and then. It's a constitutional coup d'etat.

Another Alternative to Impeachment.

Here is a perfectly constitutionally legal form of coup d'etat that can be used to oust Obama without going through a nasty impeachment process.


Amendment 25 Section 4

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.

Thereafter, when the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Vice President and a majority of either the principal officers of the executive department or of such other body as Congress may by law provide, transmit within four days to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office. Thereupon Congress shall decide the issue, assembling within forty eight hours for that purpose if not in session. If the Congress, within twenty one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty one days after Congress is required to assemble, determines by two thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office.


Imagine the following scenario.

1. Joe Biden organizes the principle Cabinet members to side with him and declares Obama to be unable to discharge his duties as president. He submits this signed declaration to Orrin Hatch and Paul Ryan and assumes the Presidency.

1a. As an interesting variation, "either the principal officers of the executive departments or of such other body as Congress may by law provide" suggests that Congress can pass a law naming another body besides the Cabinet that can side with the Vice President. What if Congress were to pass a law allowing, say, a body of NYT and WaPo editors, ABC-NBC-CBS-CNN-MSNBC journalists, and college deans - a totally unelected body of people - to legally declare the president incapable of discharging his duties? What if Biden gets these "intellectual elites" to side with him to oust Obama?

2. Obama then fights back by sending a letter to Hatch and Ryan stating that he is not incapable of discharging his duties, and he declares that he has resumed the Presidency.

3. Biden then gets his supporting body to redeclare within four days that Obama is still unfit for office.

4. Once Biden redeclares that Obama is unfit, Congress must then assemble within 48 hours if in session, or within 20 days if in recess, and vote to accept Biden's declaration by 2/3rds vote, or to accept Obama's declaration that he is still fit for office.

5. Congress sides with Biden and declares Obama to no longer be President.

6. Joe Biden takes over as acting President of the United States.

Hey, I can fantasize, can't I? The question now is whether Obama's academia sidekicks in the Cabinet support the country they were raised in, or if they will follow Obama over the cliff?

You’re right, it’s right there in the 2nd Amendment, but it has to be done by a well regulated militia not just a mob.

Impeachment, but no one has the balls to do that. Democrats could en masse call on Obama to resign and let Biden sit in the White House for the remainder of his term. Chance of that is less than nil.

Yep. PJ O'Rourke once noted that this means Congress could declare that the Terre Haute Elks club is the "other body" and then team up with the VP to declare the President unfit.

I think they would have to do this well in advance, because the President has to sign it before it becomes law.

For Obama, were stuck with the Cabinet of his choosing. So the question is, has Obama gone so far off the rails that even his Cabinet can't take it anymore? Is their loyalty to him personally, or to their country and the Constitution they took an oath to defend?

You really want to set that precedent? And have every conservative President (assuming there ever is another one) subject to the same tactic? That's really "a permanent solution to a temporary problem."

I prefer our system to the parliamentary/ministerial system in most of the rest of the world.

Yes. Politically speaking, if you have the votes to name some other body (over a veto), then you have the votes to impeach or remove by 25A.

The 25A is basically extending impeachment (and a 2/3rds vote) to the case not of “high crimes and misdemeanors” but of incapacitation.

I've thought of this scenario, but I can't imagine Idiot Joe Biden "organizing" anything, and if you're trying to get a majority of the Cabinet Secretaries, good luck. Anyone, including Biden, would be better than 0bama, who I think is becoming increasingly unbalanced.

BTW, 0bama has a "Death List", not quite as elaborate as the Clinton's, but the subjects are still dead nonetheless. ANY hint of dissent, and it will grow, and don't think that the Cabinet Members don't know that.

You read the constitution.
You comprehended that forcing an election early is not found in the constitution (hence unconstitutional).
You asked the question anyway, knowing full well what the answer is.
