On my way to the NRA annual meeting, I passed through Lordburg, New Mexico on I-10. It is a convenient place to fuel the truck and myself, so I pulled into a truck stop to grab a sandwich.
Open carry is protected by the New Mexico Constitution. I was carrying a Glock 17 (9mm for those who have not kept up with Glock nomenclature). The young woman behind the counter had a streak of purple hair, multiple piercings, a sizable tattoo on her right forearm, and was friendly, courteous, helpful, efficient and pleasant to speak with. I could not ask for better service.

I don't often open carry here in Mississippi, but that statement seems to be apropos here too.....so far.
People get acclimated to open carry pretty quickly outside the hard left hives like Ann Arbor.

It seems as if every stagecoach in old west movies, no matter where the movie was set, was going through Lordsburg. In actual fact its a damn long way from anywhere. A nice town but a long way away.
Maybe a long way away from everything, but it was - and still is - on the main southern snow-free cross continental route.
And we all know all of the cowboys in the movies went to, or through, El Paso...:^)

Went through on my first driving trip west on I-10 late at night years ago. It looked like a huge city coming down from the mountains
I’ve seen OC in multiple locations in NM but never in either Albuquerque or Santa Fe. I think OC in Santa Fe might draw more than a glance from the constabulary.
I open carried in Albuquerque, once, while exercising (a 4 mile run). I was on a business trip, and did not get hassled.
It was several years ago.

I’ve found the so-called hip, slightly weird, trendy town of Sedona, AZ is more gun-friendly than the self-proclaimed “cowboy” town of Prescott, AZ. Go figure.
I’m honestly surprised the open carrier wasn’t harassed by the cops. In New Mexico, you cannot legally open carry into establishments that sell alcohol, any alcohol. Most, if not all, gas stations sell alcohol (in NM, distilled spirits, wine, beer, mixes, etc... can all be sold in these places).

Read the bottom half of page 4 and the top half of page 5 where the law is cited. All things considered, it's easier to figure out the carry rules as regards restaurants serving alcohol than it is to be certain you're not afoul of the rules of an Indian tribe because you crossed some line on the map without noticing it.

If the open carrier has a CC permit, they can open carry in a place that sells alcohol. A CC permit does not require you to carry concealed.
I see your point and read another section on page 7 that appears to deal with this. On its face, fairly straightforward in that you are licensed for concealed carry and that allows you into more places than if you OC without a license. I’m not volunteering to be the court case for OC in the Handi-Mart with beer sales while also being a licensed person who chose not to conceal. I guess if you live there it’s just the way it is while those of us from out-of-state see that as a very confusing status.
The point behind the NM CC permit is to carry concealed. I'm not certain there is case law regarding this, but I've heard it discussed by a few CC Permit trainers in the Albuquerque area (on KKOB 770 AM) and the understanding is that there is no open carry where alcohol is sold in New Mexico.
I can dig further and find out for certain. It may be one of those grey areas, as it's not specifically stated in the law. The law states concealed carry permit holders may, but the assumption at that point is that the carriers are carrying concealed.
In New Mexico, your first case is false, and is directly established here.
I re-read the law and the "concealed" part stands out clearly in section A 4. It is considered to be unlawful carry unless you fall under an exception. The exception noted in A 4 is "by a person carrying a concealed handgun who is in possession of a valid concealed handgun license for that gun pursuant to the Concealed Handgun Carry Act [29-19-1 NMSA 1978]."
In your second case, you may carry openly in NM with a CC permit, but there are still limits on where you can go.
