Can anyone explain to me how sharing heirloom seeds could be a patent violation? By definition they have to have been around for 50 years or more.
Sharing seeds or replanting seeds from a hybrid doesn’t necessarily yield the same plant, so the issue there is the customer doesn’t really get what they may be expecting, if it is labeled with the same name as the hybrid.
But heirlooms are different. How about this: What if the neighbor and I just give each other a tomato. I’ll give him a Roma, and he gives me a Mortgage Lifter just to see if we like the flavor. Then we each eat the tomato we have been given, but scrape out the seeds and save them?
Who would even know, if we didn’t tell?
