Maybe there was no other evidence that could be brought to bear in that case. So filing priority won out. There is no doubt about who got there first. The Patent office of the day numbered every document that came in. Bell's attorney brought his patent in in the morning and it was numbered "7" and Gray's caveat document was brought in later in the day and it was numbered "39".

well that’s what I said, filing priority. also wasn’t this during a time when the USPTO required, where possible, a working model of the invention to be brought to it?
