Those are European Starlings and are designated as pests by the Fish and Wildlife Service and Uncle Sam would appreciate it you exterminate them with extreme prejudice as they are non native and desecrate the habitat for your Robins and other indigenous song birds.
If they were migratory birds or protected..the shooter could be in trouble.
Unless of course they are Wind or Solar power exempt.
