And is the equivalent of driving 65 in a 55 zone - is it against the law? Technically, yes.
Why don't the Troopers pull over everyone exceeding 55? Because it's not really a big deal, and normally considered an acceptable practice.

Why is a big deal being made out of this, then?
Because the Colts forced the Official's hands on this and went public, and because a lot of NFL fans hate the Pats, and because it sells newspapers and air time.
Pagano is a whiner - that is the real story.

Armed robbery is a common practice too. Does that mean you don't punish it when you catch a perp?

Selective enforcement of its rules is one reason the NFL has a credibility problem.
