Alternate headline: “America discovers new reason why no one should live in New Jersey.” If you’re feeling deja vu right now, there’s a reason: The case of Caitlyn Ricci is bizarrely similar to the case of Rachel Canning ... after Canning moved out of the family home and sued mom and dad for child support...
The Ricci case is similar except that Ricci’s even older than Canning was. Rachel was 18; Caitlyn is 21, an adult legally any way you slice it. And yet, under Jersey court precedent, mom and dad may need to fork over a cool 16 large annually for her tuition at Temple even though, to hear them tell it, she hasn’t said a word to them outside of court in two years. (Her parents asked her to at least attend a school in New Jersey so that the tuition burden would be lighter but she insisted on going out of state.) ...Ricci now lives with her grandparents, who are fully behind her and who are even paying for the lawyer who’s suing her parents.
One important footnote here: An issue in the Canning case under Jersey law was whether Rachel had been legally emancipated. If so, if she was “beyond the control of the parents,” then she’s an adult for legal purposes and no one’s under any obligation to her anymore. It so happens that Caitlyn Ricci’s parents were in the process last year of suing to have her declared legally emancipated; once Caitlyn found out that was in the works, she turned around and slapped them with the tuition lawsuit. Tell me, though, legal eagles, why do you even need an emancipation ruling in the case of a 21-year-old? Doesn’t Caitlyn reaching the age of legal adulthood constitute de facto emancipation? I don’t get it.

What is the age of majority under NJ state law?
OK...Make the spoiled Brat pay for the care her parents need, when they are old and frail.
In some Asian country’s it is the legal responsibility of childern to provide for the care of their elderly parents.
A couple of thoughts:
1) Amendment XIII US Constitution, Section 1:
Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.
It would seem that compelling one adult to pay for the education of another adult is “involuntary servitude”.
2) If the grandparents can afford to fund the lawsuit and support the 21 year old adult, why don’t they just subsidize the tuition?

You reach age 18 and move out, you’re by definition “emancipated”
Let her pay her own tuition.
I understand all teenager hate their parents at age 15 (trust me, I have 3 teenage daughters) but to continue into age 21 is a whole new level of immaturity
That seems to be true in my opinion as well. Seems to me a family spat doesn’t belong in court regardless.
One reason we have social security is the politicians said that Americans don’t take care of their parents so the gov’t has to.
Or the adult child could get loans or a job and pay for her own college.

But, emancipation or not, once she’s 18 the parents are not entitled to see the grades she’s getting at the school where they’re being forced to pay the ridiculous tuition.
I bet dollars to donuts that in there to force settlement agreement they agreed to support this child to age 21 and maybe even send her to college. when they did that they created a third-party beneficiary to the contract. The daughter can sue to receive the benefits promised in the contract.when I do these kinds of contract I never agree or let my client agreed to this kind of quiet but it’s very common.

This is a newish concept. Hard to believe that 130 years ago, it was “normal” in many areas for 17-year olds to live independently, marry, and have children responsibly.
