Will Tony Stewart face prison time for the collision that led to the death of another driver, Kevin Ward, Jr.?
According to Sports Illustrated legal analyst Michael McCann, it is possible.
McCann stopped short of saying that Stewart would face intentional homicide charges, but "he could face something called negligent homicide ... reckless, careless behavior that causes an accidental death."
"Because of the way [he] behaved so recklessly, [he] could be charged with a felony, and that felony carries up to four years in prison," he added.
McCann was clear in the interview that there were no pending criminal charges as of Monday afternoon, and that the discussion was speculation.
He also mentioned that more video and driver testimony could come, which could frame the possible charges that might come against Stewart.
"We don't know if other racers will give public testimony or if there are possible videos that could show more evidence against him," he said.
“then turn the vehicle in a different direction, hence missing the kid (Tony had hoped). Is this not correct?”
Ya know,,,, I admit I’m not experienced enough to say what happens when you turn your front wheels in the “not Normal” direction. I raced karts on dirt, and did 15 laps in a friend’s Sprint car on an empty track. Stalled it twice. Everytime I gassed it, the reared slid up track. I never tried to get it to slide down track
Oh! And,,,, after 15 laps, my wrists hurt, and my forearms were just shaking! Gotta have much stronger arms than mine to drive Sprints! The ruts are murder! But dirt is so much fun!
I wonder about that too. The kid was wearing a mostly black suit with some white details. The same color scheme as his car. The direction he was moving put him between his car and Tony. Did his suit make him blend into the background of his own car?
Posthumous note to Kevin Ward Jr.-—stupid can be fatal.....
Yeah. In my youth I raced (yes on a track, not the streets) and crewed on a dirt track team. To this day I’m still an active volunteer in a local racing group. Rule 1 is stay off the track, stay in your vehicle unless it is on fire.
Yeah, everyone in racing had incidents. Only we call them experience. Some good, some bad. That’s how you learn. I have personally been idiotic close to some cars going very fast. Had I gotten hit the fault would have been mine because I put myself there. On one occasion I stayed, in cover, because idiotic close was where I needed to be. In the other I got the h@ll out of there ‘cause dang, that was way too close.
Bwa Ha. I'd never even heard of the guy before I saw the video. But hey, why argue the facts and evidence when you can just call someone a "hater" or a "racist" or a "sexist" or a "homophobe" and then declare the discussion over with a "Nuff said".
Have you ever considered working for Eric Holder or Barack Obama? they just love using tactics like yours.
Exactly
You don’t gun your engine and use a deadly weapon to veer into a living person. that’s the real LAW that applies here, and it’s called manslaughter.
I thank you for your civil response. I have to say that the other cars did not use throttle when they were near (although not as near) Ward. Also I would assume Stewart who is a champion would be more than enough of a competent driver to correct his car in the direction he wished it to go. But not only did it not take him to the left or keep him going straight, his supposed correction led him right into Ward. And that to me is hard to swallow.
I didn’t read the article, but I’m going to go with “none”.
Running out on a dirt track at night amidst cars zooming by, driving by guys in vision-limiting helmets doesn’t seem like a very good idea.
I’m pretty sure there’s always a driver meeting before the race and that one of the points emphasized is “stay in your car”.
Young testosterone sure, but Ward had four or so years of sprint car experience.
BTW, Stewart had a close friend killed in a sprint car accident just last year.
SOP to remove RR Tire and put a LS Tire on a Sprint Car to put on the trailer. There is a major size difference (diameter and width) between the 2 tires. This is done to make the car level and narrower to fit in trailer. This was nothing out of the ordinary. The Sheriff was there and aware of this.
There is no cover up, deceit or tampering of evidence going on here.
OK. Thanks. I didn’t know this. As I said, I was commenting on what others’ said but it did look out of the ordinary to me. Glad to have your input.
