Homeowner: 2 teens shot were 'vermin,' not human

LITTLE FALLS, Minn. — A Minnesota man who killed two teenagers who broke into his home can be heard on an audio recording talking to himself for hours after the shooting and at one point, apparently describing the slain teens as "vermin."

Byron Smith, of Little Falls, faces first-degree premeditated murder charges in the deaths of 18-year-old Haile Kifer and 17-year-old Nick Brady on Thanksgiving Day in 2012. Smith, 65, claimed he was defending himself and feared for his life after several break-ins at his home.

Prosecutors, though, say Smith planned the killings. They say he sat in a chair in his basement and waited for the teens to enter his home, instead of calling police.

Smith waited a full day after he shot them before asking a neighbor to call the authorities....

The killings stunned this central Minnesota community and stirred debate about how far people can go to defend their homes. Under Minnesota law, a person may use deadly force to prevent a felony from taking place in one's home or dwelling, but authorities have said Smith crossed a line when he continued to shoot the teens after they were no longer a threat.

Authorities who searched Smith's home after the killings testified Wednesday that they found an audio recorder that was turned on and an operating video surveillance system. The recorder was sitting on top of books on a bookshelf, near a chair where prosecutors say Smith waited for the teens....

Prosecutors also showed images from surveillance cameras that Smith had set up outside his home. The four different camera angles showed Smith leaving his home in his truck at 11:25 a.m. on the day of the killings, then returning on foot at 11:45.

At 12:33 p.m., Brady shows up in a hooded, camouflage jacket ...

Sure, but the point here is that he went beyond self-defense. You seem to be saying that, once they broke into his house, their lives were his to do with as he wished.

“He dragged Kifer into the workshop, placed her next to Brady and noticed she was still gasping for air.

“Smith stated at this point he placed the handgun under the woman’s chin and shot her ... up into the cranium ... a good clean finishing shot.”

He asked a neighbor the next morning if he knew any lawyers, and that neighbor apparently called police.

He had their dead bodies in his basement right next to his favorite chair for 24 hours and was still not going to call the police.

Doctor: Slain Teen Was Intoxicated On Cough Syrup

An 18-year-old woman who was fatally shot by a Minnesota homeowner was intoxicated on cough syrup when she and her cousin broke into the man’s home, a medical examiner testified Thursday at the homeowner’s murder trial.

Under cross-examination by the defense, Dr. Kelly Mills with the Ramsey County Medical Examiner’s Office said Kifer had an ingredient from cough medicine in her system at a level that would make her intoxicated.

Mills said the drug, dextromethorphan, can cause hallucinations, disassociation and an out-of-body experience. Kifer’s toxicology tests also showed the presence of a marijuana metabolite that Mills says had no hallucinogenic effects. Brady had no drugs or alcohol in his system, Mills said

Some here don’t realize that this isn’t a trial to prove that he was or wasn’t being burglarized, or whether he shot or didn’t shoot the burglars.

The trial is about him admitting that he murdered at least one of them and probably both of them, for instance after thinking that he had finished off the girl, he moved her body and put her on a tarp, when she groaned, he put a pistol under her chin and gave her the coup de grâce to end her “suffering”, he did not do anything to contact the law until more than 24 hours later.

I don't think a reasonable person believes someone unarmed and dying in front of you is a threat of death or great bodily harm-if he believed that, he probably wouldn't come as close as he had to to deliver a 'kill shot' under the chin

Felony? it depends on the value of what they were stealing. (At least that's what was taught in police academy way back when.) I'm sure burglary laws have changed since then. I do rememeber that burglarizing a garage VS the house would result in lesser charges...UNLESS the garage was equipped with a bed(and maybe a toilet) that got used now and then. Then it could be considered an 'abode' or 'dwelling' and treated equal to the house.

csvset is right, Bubba.

If you take cough syrup and you feel its effects, you've abused it.

You should only take an amount of cough syrup too small for it to have any noticeable effect.

Same thing with aspirin - if you take so much aspirin that it causes a headache to go away, you are clearly abusing aspirin.

What I see is a scared, angry old man. Scared because these punks keep breaking into his house. Angry because the cops can't catch these kids.

Having to shoot two thugs that are breaking into your house doesn't make you a hero. Hero? Who's tossing that word around other than you?

The purple drank drinking skank and her dopey, (dopey in this case as in stupid), friend who felt that they owned this old man's very existance, perhaps they are heros? If they weren't traveling around repeatedly breaking in to people's homes, perhaps this old man wouldn't have to experienced this nightmare.

Yep every scared homeowner I know always goes out and parks their vehicle 20 minutes away so that anyone coming up to the house will think it's empty. That sure is the mark of a scared homeowner.

And that fear so paralyzes you that you forget how to dial 911 after delivering the "good clean finishing shot" that makes your day.
