What about Sarah Palin Jim? She is the only Constitutional Article 2 Section 1 true natural born Citizen that was born with ‘sole allegiance’ to the United States that is truly a conservative blessing for this country. She is what America needs and the election of her would be adhering to the founders original intent of not putting a person born with split allegiances in the oval office. That is being a true Constitutionalist.
“Under the Common Law of England anyone born in the country with few exceptions was considered natural born.”
And the British call sausages “bangers”.
What’s your point?
The simplest way to look at it is the following: if you are a citizen without the benefit of any Act of Congress or any Amendment to the Constitution, then you are "natural-born," if you become a citizen because of any act of man, then you are a citizen, but not "natural-born."
Ted Cruz is a citizen because of legislation that grants citizenship to the children who are born out of the country but have at least one citizen parent. This legislation used include requirements as the the age of the citizen parent and the number of years they had lived in the U.S. - not sure that it does anymore.
Congress made one attempt, shortly after our nation's founding (I believe in the 1st Congress), to grant "natural-born" status to those born out of the country to 2 citizen parents. They obviously realized later that they were defining something that could not be defined by human intervention, as they removed that provision from the new Naturalization Act in the subsequent Congress.
The determination of "natural-born" lies beyond the reach of mere mortals!
We are not under English Common Law.
We are not in England, we are not commoners. we are sovereigns. Our constitution has no provision for adoption of the laws of another nation; all of our laws must be passed by our legislative bodies.
Thankfully, there are some birthers who will not do that. I have seen a number of them on the forum who are coming to grips with the reality of what their position will mean. The concept that Hillary or Christie have the kind of citizenship allowing them to be President and not Ted Cruz is simply inconceivable.
Here is a summary of the arguments:
1. There is no law, no precedent, case, no definition of this issue as put forth by the birthers anywhere in any court case or law. None. Zilch, zero, nada.
2. Cruz was given a US birth certificate immediately, he was not naturalized, his parents did not have to go through any unusual manner to get his citizenship, it was automatic.
3. The original intent of the issue was not to have a President with divided loyalties. Cruz has no divided loyalties toward the US founding, most of his opponents do.
4. There is a big divide in thought on the matter, some good arguments from both sides in the conservative arena, but there is no clear winner, because there is no clear court precedent. Why take someone out as good as Cruz over a difference of opinion on this niggling point?
5. Even if the birthers were right (debatable), for us to take out one of ours on a point that they ignored for two elections would be political suicide and make us the stupidest part of the stupid party.
I think there are other main points to argue, but these are what I have read. Xzins and others, kindly add other points than what I have made here. I would like to make a good, comprehensive list of the arguments that have been put forth.
I said if Cruz is the strongest conservative running. But neither Cruz or Palin have declared. We’ll have to wait and see. And as far as I’m concerned, I’ll go with Levin and others who say Cruz is a natural born citizen.
If the MSM chooses to create an anti-Cruz birther movement that isn't just limited to left wing Cruz haters, the MSM is going to have a real uphill battle. Cruz really is eligible.
LOL! I defend the constitution. Don’t like it, piss up a rope. Your call.
Has Levin actually stated clearly and unequivocally that Cruz is a natural born citizen?
Yes, blogs are the definitive authority on pretty much everything.
Read what he said at the top of this thread.
I will abide your rules regarding nastiness to other Freepers.
I am under no illusion that you need follow your own rules.
A blog is a cyber-document.
Some blogs are useful, and have useful information, other blogs are useless, and have useless information.
Discernment is the key......
I don't know about that, but it might provide incentive for those
who think birthers are ate-up to heap upon you steaming piles of invective.
No, I've not had a seeing. Just 'splainin'.
The ONLY one? You know the whole population of the country?
Lots of folks right here on FR say the same dang things she does.
Why do you assume we are all foreigners?
To paraphrase your own words:
There is no court decision anywhere since George Washington was President, no precedent anywhere that makes these after-birther opinions law.
No where. Just gobbledy gook on the internet and from after-birther mouths. Levin is right, he hasn’t studied the subject, but can’t refrain from being nasty.
Cruz was given the birth certificate and was automatically naturalized by Congress’ authority under Article 1, Section 8.. he is a US citizen from birth. He ISN’T a natural born citizen until some idiot after-birther wins a court case for him.
With the current injustices on the supreme court, you’ll probably have good luck with that - if they ever stop evading the issue.
Levin declared him one by doing it in the flawed current political correct way stating:
Ted Cruz was born to an American mother making him a citizen, therefore he is a natural born Citizen.
Levin is wrong by conflating Citizen and natural born Citizen.
I did read what Levin said and he never once clearly and unequivocally stated that Ted Cruz was a “natural born citizen”.
Dude, I’m on your side. I love the guy (Cruz); I think he’s hell on wheels, a young Reagan on steroids.
Read every post I’ve made here in over 9 years and then tell me I’m a plant. You know I’m not. I’m trying to be consistent with what I believe the intent was from our Founders. That’s it.
I’m not going to clam up because it makes people uncomfortable.
Well, look. You accuse me of not defending the constitution and then you double damn dare me to ban your account. Do you expect me to say thank you sir may I have some more in response to your belligerent nastiness? Keep up the good work. Cruz has not even declared yet and already you’re looking to self-immolate.
Reason and logic? LOL!
Been there, done that. Bought the T-Shirt.
