Today, July 10th, is DAY #22 (of 5th week) State of Florida V. George Zimmerman case.
Yesterday began with a boom as defense expert witness, world renowned Dr Vincent Di Maio took to the stand to validate the forensic evidence supporting George Zimmermans version of the encounter with Trayvon Martin. However, the day ended with an even bigger THUNDERCLAP in an epic 10pm showdown as Don West took on both the State prosecutors and trial Judge Nelson after the jury was released. Ending with Judge Nelson, turning her back and walking out of court. Unreal. A great analysis of the events from yesterday is available HERE.
The late night argument, not by the State, but by Judge Nelson herself, regarding phone evidence authentication, is so weak and insufferably devoid of legal analysis it is absurd on its face. Then again, this is the same judge who said a few days ago, flippantly in open court, that evidence should be shredded (Dr. Bao notes) after use. Doh
Essentially Nelson argued that the phone records (texts and pics from Trayvon) cannot be authenticated to have originated by the specific personage of Trayvon Martin (despite two security codes) because anyone could have sent them. Whiskey*Tango*Foxtrot !!
How can an email be used in a sex offender case? How can phone records be used in RICO cases? How can GPS evidence be used in Insurance Cases? How are photographs taken by perps used against them? Think about it.
You cant argue that evidence cannot be admitted because someone else might have made the actual phone call; Someone else might have physically sent the email; Someone else actually accessed the website; Someone else might have been the driver of the car; Or, someone else could possibly have been behind the viewing lens of the camera etc.
No, that argument does not mean you can arbitrarily exclude evidence. And this was the basis for her argument (watch the video).
Sure, thats an argument which can be presented to the jury by the other side, as a counter point to create doubt with the jury, but it cant be a reasonable consideration for total evidence exclusion. Then again, this is Judge Nelson who in multiple prior cases has a high historical propensity of being overruled by the 5th District Court of Appeals.
It should be noted the NAACP Annual National Convention starts in Orlando on Friday; Additionally, preparations are being made in/around Miami-Dade for a Wednesday defense wrapped up with a community/LEO preparation meeting yesterday.
Can’t get a 90% angle of entry if Martin was straight up
I’d hit that!
Thanks. My wife, who was a court reporter for a few decades, told me she never saw a “judge” just get up and walk out before I showed her the YouTube last night. She was 100% appalled.
It looked like she flipped her wig when West said the prosecution has been “lying.” That’s why I was wondering if she threatened West. She probably did, in chambers so we wouldn’t see. LOL.
Was that a quote from the courtroom? I am without audio here.
Thanks.
>> I wonder if they did it on purpose.
I think Guy DID ask on purpose, in an attempt to trap O’Mara.
Guy is the one who had the smart aleck comment for West last night when West accused the pros of lying about discovery.
Has a big chip on his shoulder now.
LOL—Complete role reversal: the witness is questioning the persecutor!
Amen to that. And he can’t bother to get up off the floor to ask his questions. This is just...I dunno what to call it.
LOL!!!!
Angela Corey is seated in the court room!!
Angela Corey seated front row in the Zimmerman trail
State is again on the 90 degree angle of the shot. I guess they are pushing the idea that TM ha finished beating on GZ, was dismounting and GZ then had no reason to fear death or great bodily harm.
Is that about right from the State pov?
I think he’s proposing to the doll in that photo!
Yes, the poor witness said, “I’m getting lost.”
The punk prosecutor was babbling on about angles of the shot ad nauseum to the point of utter confusion.
man that guy is smarmy
I believe the judge may know Z is innocent, but she is still trying to railroad him, in my opinion.

“She is doing everything she can to put the burden on the jury.”
Exactly! That is what truly reveals the moral bankruptcy of this show trial.
I pray the jury has some moral courage, unlike the State of Florida, the judge, and the prosecutors.
Thanks so much for that photo.
She is one ugly and bitter looking female!
Ya I know right!! That’s really just as bad as him saying “ we’ll trayvon didn’t have a history of fighting so how can you assume” when he knows damn well they can’t talk about it!!
There is overwhelming evidence that TM was a cruel, violent demon boy that loved to fight. The state knows this and the judge knows this, but yet they cannot allow this truth to enter the court room.
So true. The travesty of this is that the jury, if they really were unaware
of the particulars of this case, may rule without the benefit of all the facts.
The exclusion of the text messages/photos is particularly troubling in that regard
i dont understand that seating
is no one else with her in the front row and Martin is behind her in second row
does anyone know yet if they have the option for manslaughter?
