I just discovered this news release and hadn't seen it reported elsewhere. Our honorable Judge Malihi evidently has a tradition of being overruled by the Secretary of State. Could history repeat itself ... or maybe like the Obots have claimed, this judge is incompetent???
June 7, 2000: Georgia Secretary of State Cathy Cox today ruled that House District 29 candidate Randy Sauder will remain on the ballot as a Democratic candidate in the 2000 General Primary and General Elections. In an order signed today Ms. Cox ruled against a challenge to Rep. Sauders candidacy brought by petitioner Marston H. Tuck.
Secretary of State Cox rejected state administrative law judge (ALJ) Michael Malihis initial decision in the Sauder matter, which procedurally serves as a recommendation to Secretary Cox, the states chief elections official. Ms. Cox found flawed the ALJs interpretation of Georgia election law governing the qualification process for candidates, and endorsed the opinion and guidance of Georgia Attorney General Thurbert Baker.
She gives several points of law as to why she rejected the ALJ's decision. This one really stood out:
"First, accepting the view of the ALJ would mean that a candidate can determine his or her own qualifications ... "
Is this not deja vu all over again??
Misleading headline.
Should be pulled.
The judge has been over ruled by the SOS. Its a valid thread title.
Fogbow misleads not FR. How is crazy Foggy doing?
No it shouldn’t. Perfectly legitimate.
It’s a proud day when somebody essentially tells a judge to go play in the street.
No only NO but really NO.
Such a decision would take the kind of political courage that is never seen these days. Such a decision would be the end of the Secretary of State career.
You can tell by the words used by Malihi to justify Obamas citizenship as unquestioned that he was grasping at vapors to say that Obama was eligible to be on the ballot. The man simply feared to put it in writing that there were grounds to deny Obamas eligibility.
NO Secretary of State will remove Obama from the ballot and the chances of Judge ruling the Obama is not a Natural Born Citizen are incredibly slim.
Any officer of the state or judge that stands in the way of the reelection of the ONE is inviting a storm of hate such has never been seen since the assassination of MLK.
I wish that the people of this country more knowledgeable of and had more respect for the Constitution but I am afraid that it has been bred out of most of us. We have no choice but to beat the Kenyan at the ballot box.
Perhaps after he is beaten in a landslide in November the truth will come out.
Ding-ding-ding! We have a winner.
Why did Foggy aka Bryan state “He is fighting the madness” when the official records at the California Bar tell us Foggy is officially insane?
How many times has Foggy been in a straight jacket?
He photo shopped Orly in a straight when hes officially crazy??
Right now, the important thing is vindicating our mistrust of Malihi’s competency. He was supposed to present “findings of fact” and “conclusions of law,” but he presented only “opinions of error.”
Liberals won't care when it does. Law Enforcement might, however.
Is that you Mad Foggy?
Should be pulled.
Agree. The article is dated June 7, 2000. LOL!
Liberals won't care when it does.
If by that you mean that the Libs wont care that Obama lied about his birth or his eligibility to be President I will agree with you.
But I if you mean that the Libs wont care that the truth was told I do disagree.
If the truth is told the Libs will be up in arms to deny the truth and they will slander the truth tellers as racist.
Nothing angers the Libs more than the truth.
Wasn’t Kemp a Rep in the U.S. House of Representatives when he sent a letter to Obama, in 2008, accusing him of being ineligible?
Thought I read that somewhere here on FR?
Well, well, well. A 'newbie' moderator in training! Just what we need...another wannabe!
The title is misleading?...why?...as it relates to this judge’s past history, it is spot on...rules are you don’t change the title of an article...check the date before you read...just sayin’
