Perhaps in theory. However, I’ve had personal experience with this matter. A neighbor who’s guest continually parked in my spot. Neither the police nor the towing service will act on the complaint of a tenant, only the owner/manager.

My personal experience was coming "home" to find my parking space occupied. I used the adjacent one. The "owner" of the spot punched an ice pick through the side walls of both left tires. My insurance company covered a replacement of a full set. The next time I came "home" to find my spot occupied, I called the most expensive towing service in town and had the offender removed. I notified the manager in the morning as it was 1:30 AM. The manager concurred with my action and thanked me for not waking him. I never had to deal with another person parking in my spot.

BTW, the parking lot is posted with signs saying that unauthorized cars parked in the lot will be towed.
