In an audio tape apparently recorded by the mother of his infant daughter, Mel Gibson is heard using racist and misogynistic language, reportedly calling ex-girlfriend Oksana Grigorieva an embarrassment and telling her, You look like a fking pig in heat, and if you get raped by a pack of ners, it will be your fault.
The tape's contents were first reported by RadarOnline, which also claimed to have heard it. According to the site, Grigorieva made the recordings "during a series of explosive arguments" between the couple, who split in April and who are currently in a financially tinged custody battle involving their 8-month-old daughter, Lucia. Records in the case are sealed -- at least, they're supposed to be.

You know, as much money as this chick is set to get from having custody of their daughter, how hard would it be to get an audio together of him saying something like this? Just curious. I mean he has said so much stuff on film and hey, he may be a drunken racist (ok, he has issues with jews apparently and obviously drinks to excess) but I also have become skeptical lately when there is a ton of money involved.
Of course he could have avoided this altogether if he kept his vows to his wife...

Invade privacy? If the person is repeating what is said to them, they have not "invaded privacy". Betrayed a trust, maybe--but you cannot lock up (or pillage the belongings of) anyone who betrays a trust.
As soon as you start distinguishing between "acceptable" speech and "not covered" speech, you have already tossed out the 1st amendment--the only question left is how strict a censor you are.

Recording someone? I think you are mistaken about what free speech is.
In fact, is it ok with you if your girlfriend records you having sex and then sells it to the media and it plays on tv? Not that anyone would want to watch it, but is that ok?
Gibson is scum, and you can bet 99% of all stars [and anybody else] have said things in private that would poison their public image. That is no excuse for Gibson, merely a truth we ignore just to get along with people day to day.

Recording someone is not speech, free or otherwise.

What ARE you talking about then? She recorded him. That is what I’m talking about.

The disclosure. If the recording was made in accordance with the laws of the state (I do not see that the Feds have any constitutional mandate in this--though an amendment establishing the privacy rights of Americans would probably be a good idea), then what is done with the tape is the business of the owner. Even if that includes disclosing distasteful remarks.
If the recording was against the law, then we deal with that and not hand-wring about the rest.
Wonder which state she did this in? IIRC there are 18 states where you need both parties permission to tape something. That is how they got ACORN out of their trouble in Delaware. If the state it was recorded in is one of those sttes this could backfired on her and it be her that would be in trouble. I’m not excusing what he did but who would think that in your own home you would be taped?I’d say someone is trying to influence the judge in the divorce.
