The same thing was happening with the Coleman-Franken challenge in Minnesota. Coleman's challenges to absentee ballots during the recount were decided by the courts/SoS to be more appropriate to the contesting phase and deferred, and then when the counting tipped Franken's way, the courts ruled during the contest that Coleman's challenges should have been made during the recount.
