“But the Supreme Court essentially wrote the Privileges or Immunities Clause out of the 14th Amendment in an 1873 decision called the Slaughter-House Cases. The result was predictably disastrous: People who lacked political power would be denied the ability to gain any economic power and stripped of any meaningful ability to protect themselves from the vicious reprisals and Ku Klux Klan violence that soon became a shameful hallmark of Reconstruction.
“The Slaughter-House Cases were wrongly decided — indeed, there may be no question on which legal scholars are in wider agreement than that the Slaughter-House decision is indefensible. But for over a century, the Supreme Court has simply ignored the Privileges or Immunities Clause and has protected rights in a largely ad hoc manner that gives more weight to the justices’ personal perceptions about which rights are important than the convictions of those who ratified the 14th Amendment.” [snip]
[Just a layman’s take: Justice Thomas left me with the impression that the earlier court had sided with a monopoly in the Slaughter-House ruling and sought a loop-hole. The earlier court therefore pretended that the 14th Amendment failed to specify between ‘state citizen’ and ‘US citizen’, while the wording, ‘citizen’, is generally assumed to mean ‘citizen of the US’, and that was the clear intent of the amendment. They bastardized the amendment’s righteous purpose to aid the profits of a slaughter house monopoly. This might be a good example of how states used to choose their senators, and the resulting justices were tempted to veer rulings like corrupt crony activists. With the potential of a better informed voter than ever before, I think it could be a travesty to trust state legislatures to appoint senators again — maybe half the senators? Just a thought.]

ANOTHER WHALE OF A TEST
The giant Taiwanese oil skimmer known as ‘A Whale’ is getting another chance to prove its value in the Gulf of Mexico. But the leader of the federal response, Thad Allen, doubts the effectiveness of the “A Whale.” Allen said Thursday it seems more useful in a huge pool of oil than in thousands of smaller slicks. Bob Grantham, spokesman for TMT Shipping, says the U.S. Coast Guard has approved another week of testing.

An outspoken Louisiana official wants the Coast Guard to lift restrictions on news organizations covering the Gulf of Mexico oil spill. Plaquemines Parish President Billy Nungesser said he’s drafting a letter to the Coast Guard, BP and President Obama opposing a recent rule keeping the public and media about 65 feet from containment boom and vessels participating in the cleanup. He says the only way to maintain public confidence in the cleanup is to make it as transparent as possible.
DISGRUNTLED PENSIONS
The exasperation with BP felt by residents of the Gulf states is spreading to shareholders — and some are taking the oil giant to court. BP shares have lost about $85 billion in value. The toll for institutional investors who hold 79 percent of the company — including public and private pension plans — is around $67 billion. At least five individual investor suits have been filed, along with BP employees.
WATER-WHIRLED
Kevin Costner’s company has sent an oil-skimming vessel to help clean some of the crude that has fouled the Gulf of Mexico. The actor told workers and visitors “the machine I once dreamed of is here to help you.” The Ella G, now one of the Vessels of Opportunity, was retrofitted to receive oil and water from the skimmer, separate the oil and place it in storage tanks, and return the cleaned water to the Gulf. It had once been an offshore supply barge.

BP’s latest oil spill response update for June 4th says the total amount of the dispersant used in the Gulf of Mexico more than 1,021,000 gallons.
But what most people don’t know is that the active ingredient of the toxic chemical dispersant, which is up to 60% by volume, being sprayed by BP to fight the Gulf oil spill is a neurotoxin pesticide that is acutely toxic to both human and aquatic life, causes cancer, causes damage to internal organs such as the liver and kidneys simply by absorbing it through the skin and may cause reproductive side effects.
In fact the neurotoxin pesticide that is lethal to 50% of life in concentrations as little as 2.6 parts per million has been banned for use in the UK since 1998 because it failed the UK “Rocky shore test” which assures that the dispersant does not cause a “significant deleterious ecological change” – meaning it can delete an ecology or more specifically delete the entire food chain.
Corexit has also earned the highest EPA warning label for toxicity which means the effects of the toxic chemicals to the eye are corrosive resulting in irreversible destruction of ocular tissue and other tissue with corneal involvement along with a burning that can persist for more than 21 days and effects to human skin are corrosive resulting in tissue destruction into the dermis and/or scarring.
Corexit was widely used after the 1989 Exxon Valdez spill and according to a literature review performed by the group the Alaska Community Action on Toxics was later linked with widespread long lasting health impacts in people including respiratory, nervous system, liver, kidney and blood disorders. Clark for Exxon Biomedical Sciences, Inc. entitled “Acute Aquatic Toxicity of Three Corexit Products: An Overview ” states that “Corexit 9500, Corexit 9527, and Corexit 9580 have moderate toxicity to early life stages of fish, crustaceans and mollusks (LC50 or EC50 – 1.6 to 100 ppm*). It goes on to say that decreasing water temperatures in lab tests showed decreased toxicity, a lowered uptake of the dispersant.
