Kelly said that any terrorist who is captured overseas and ends up on “American controlled soil” (eg., Gitmo) is afforded all the same Constitutional rights as any American citizen. So, if we are invaded by, say, Russia, and we capture thousands of Russian soldiers and put them into POW camps, we have to read each prisoner his Miranda rights (in Russian, of course) and then arraign him, give him a lawyer, set bail, etc.

I never knew it before, but the beautiful Kelly is an idiot.

True, the liberals on SCOTUS swung the pendulum in favor of the enemy combatants and away from prior precedent, but the reason for passing the MCA was to precisely deny them civilian trials and this is not unconstitutional.

During WW2, there were German prisoners in POW camps in the U.S.
They were p.o.w.`s, period. No trials, no nothing, just pow`s.

2. War is hell.
3. Captured enemy combatants are pow`s.
4. P.OW.`s are put in pow camps til the war is over.
Those are Geneva Convention rules. period.
What is all this crap going on in Obummer`s camp?
