Megyn Kelly believes Holder is entitled to have civilian trials for GITMO detainees. This is flat WRONG.
While those detained as enemy combatants are entitled to the writ of habeas corpus to contest their designation as "enemy combatants" in civilian courts per 5/4 SC vote in Boumediene v. Bush, they are to be tried under the Military Commissions Act of 2006, so long as the procedures are analogous to the rules applicable to courts-martial under the Uniform Code of Military Justice per 5/3 vote in Hamdan v. Rumsfeld (with CJ Roberts not participating).

She’s sp[eaking as a lawyer. As such, she exposes the danger of listening to lawyers about doing the right thing. Lifers (inside the beltway), lawyers and liberals; they all have a different view of life, and what the difference is between right and wrong.
Kelly said that any terrorist who is captured overseas and ends up on “American controlled soil” (eg., Gitmo) is afforded all the same Constitutional rights as any American citizen. So, if we are invaded by, say, Russia, and we capture thousands of Russian soldiers and put them into POW camps, we have to read each prisoner his Miranda rights (in Russian, of course) and then arraign him, give him a lawyer, set bail, etc.
I never knew it before, but the beautiful Kelly is an idiot.
I’m not sure she understands the real reason behind this administration’s desire for show trials. She should look at their shameful behavior toward Israel and get a clue. (And I like Megyn Kelly a lot).
If what is stated is correct this is one of the very few times I disagree with Megyn. Normally I agree with her stances.
Enough said. But if you buy his book you will get a nifty canvas tote bag.

True, the liberals on SCOTUS swung the pendulum in favor of the enemy combatants and away from prior precedent, but the reason for passing the MCA was to precisely deny them civilian trials and this is not unconstitutional.
I can agree with “that” verdict but guilty on constitutional law.

During WW2, there were German prisoners in POW camps in the U.S.
They were p.o.w.`s, period. No trials, no nothing, just pow`s.
