Making such a statement would not simply violate the judge's ethical duties, but would also, quite likely, violate one or both of the parties' Constitutional rights - many of the "procedural" rules that govern litigation are rooted in due process, and if any judge were to say that he would not dismiss an action based on procedural issues, that judge is effectively saying that the Defendant's due process rights are unenforceableDidn't SC judge Ginsburg recently say something about abortion (Roe vs. Wade) that contradicts your statement???

His mother is a citizen. He's a citizen.
He's not a “natural born” citizen.
Now, I will admit that what happened in Indonesia could cancel out all bets, but Obama’s people bought all the paper over there — then there's, that 18 year-old thingey and Anna and probably a couple or three others — so I guess there's plenty of wiggle room.

While agree with your reading of ‘natural born citizen’, the factor of being born on American soil is one which will require a SCOTUS ruling to sort out. The dems had a reason—some basis they felt valid—for preparing to challenge Goldwater on the basis of his being born in Arizon before it was a state.

I am not saying that wouldn’t happen. However, it might be a bit more difficult with that whole senate recognition thing working in McCain’s favor. That being said, he still has two American Citizen Parents.

interpret the Constitution by defining natural born citizen, not amend it.
The interpretation of the Constitution is the function of a separate arm of the federal governemtal authority, the Supreme Court. The issue is one of separation of powers and designation of job title, so to speak.

And I do not agree that liberals are consummate cowards. I think that a lot of them are VERY dangerous like Bill Ayers who killed police officers through his schemes and plots.
I also think that the Black Panthers who I mentioned are quite dangerous.

Thats how it was presented to me, that Joe acts until it is determined who is qualified. If it follows history, it will be a vote in the House of Representatives that will decide the issue. The question is whos names will be on that ballot? From my memory--only--and this is not what I do every day--
The names of the top two (or maybe the other vote getting candidates and then after a ballot state by state, it gets to the top two) vote getting candidates. That may have been modified by amendment. If not, the argument about McCain's eligibility becomes relevant--I think it is equally clear that McCain is not eligible although I know that is not a popular position here.
And as I recall, contrary to your statement, I think it is a state by state vote--with the state's ballot determined by majority vote of the state delegation in Congress including the Senators but that may also be wrong.
But if I am correct, and further correct and McCain is ineligible, you get down to Bob Barr and others.

I believe Obama became aware just before Lolo and Indonesia. I believe Indonesian events are his first memories.
Before that, Obama only has a meta-memory, created from family fables, his fantasies and political expediency.
Of his parents marriage, Obama wrote in his memoir: "How and when the marriage occurred remains a bit murky, a bill of particulars that I have never quite had the courage to explore."

John McCain was born in the Panama Canal Zone, which was US territory at the time (before Jimmah Carter gave it away). I belive that his father was also stationed there at the time, in service to the US Navy - otherwise how would that effect the eligibility of future service brats who were born at the parents overseas posting? Fred you have been around reading this argument long enough to know that isn't correct.
The "Panama Canal Zone" was not part of the US--it was part of Panama which had and retained sovereignty. Further, McCain wasn't born in the Zone--his birth certificate is in general circulation and it tells you exactly where he was born--the hospital was not located in the zone at all but in Panama outside the zone.
And does it "affect the eligibility of future service brats . . . born at the parent's overseas posting?" You bet it does and persons in the service of the US were told at basic training that citizenship and rights of any children born to them offshore were subject to different rules than would be applicable if born in the US and the differences were explained in detail. I doubt that at the time, any of these people think the kid might have a problem not being eligible to be President of the US because he was born at a duty station but that is the way it works.
If we don't like it that way, all we need to do to fix it is amend the Constitution.

My personal opinion regarding what Barry Obama tried to insert into the resoultion is that he was seeking to establish a grounds for eventual challenge that he was born in Kenya because his mother couldn't fly back to Hawai'i to birth him, but she immediately--or had her mother immediately--applied for birth record as Hawaiian native.
Democrats are lying criminal thugs who will do anything to give themselves absolution. I think Barry was trying to establish grounds for justsuch an 'extra-legal' affirmative action approach to skirting the Constitutional requirements.
If the Keyes case gets to discovery, the Obama argument may be offered that he was born in Kenay but his mother was prevented from flying home to birth him and she immediately sought Hawaiian native status for him ... a process allowed by the then Hawaiian laws. Yes, specious, but what he is capable of trying regardless of how it rips the antion apart!
The issue of his natural born status I believe with all my heart rests upon the admitted statement that his father was a Kenayan and thus a British subject. Barry even signed onto the assertion that to be natural born BOTH parents need be American Citizens at birth, when he signed onto the McCain non-biniding resolution.
In the final analysis over this lying affirmative action batard, it is the democrat party manipulating laws and the people in order to acquire ultimate control over we the people--in the death of a Constitutional Republic replaced with a federal oligarchy--that needs to be explained to the American voters. We are in the midst of an attempted coup. The democrat party is the usurper, above and beyond Barry Soetoro who is merely their race-manipulating means to the usurpation ends.

he only said he was a native citizen on his fight the smears web site
So if he were born in Hawaii or Washington, he would be a citizen -- a "native born" citizen -- born in the mainland US (jus solis).
He would not be a "natural born" citizen, since he only has one US parent (Jus sanguinis).
