Buying a new house and today while we were over at the new place painting my wife backed our minivan into the next door neighbor's volvo. Great way to meet the new neighbors right?...ouch.
Anyways I was in the passenger seat watching right (wife pulled out left so I never saw the car).
When the police showed up the officer asked me for my driver's license.
I said "Sorry officer, I was a passenger, not driving, you don't need to see my driver's license." Yea she didn't like that.
The officer said "the DMV requires us to enter the driver's licenses of everyone in the vehicle that is involved in a traffic accident. I'll need to see it."
Being that the neighbors (including the guy across the street that wasn't involved at all) were all standing around now watching I decided to not press the issue as our neighbor approval rating is already sub-congress. I handed over my drivers license (reluctantly) and said "you really don't need to see my driver's license, but here it is anyways".
She tried to speak up some more and I said "it's fine you have it already it's done". Yea she didn't talk to me again.
I used to carry an ID on me (not driver's license) for times that I wasn't driving or planing on driving...like when I was planning on drinking, but don't have it anymore.
Now I know without a doubt that since I was not driving I had no legal obligation to produce a driver's license. The question is did I have to legally produce any ID or would name and such have been sufficient?
I seem to remember a supreme court case about this a few years ago.
Yes, that's the test I took. Interesting question here - and one which nearly all democrats must answer "true". :-)

Fortunately we live in a country where our government, as well as the people, is regulated by the law. The state may want the forms filled out in a certain way but the courts have determined that they do not have that right to insist on it. Again, asking and insisting is the difference.
In my state that would amount to leaving the scene of an accident. I bumped a truck once. My car was damaged the truck was not. I couldn’t find the owner but left my name etc.
I had the cops at my house a couple of days later.
Everything in this world matters. Small, big, right or wrong.

This is a Constitutional Republic. We have the right to privacy. Thank God your opinion doesn’t trump the law.
No, you don’t have to have a driver’s license on you to be a passenger, and so if you don’t have it, then there’s nothing to produce...
You might check with some legal eagles in the state, but I’m sure you don’t have to produce your I.D. for the police. You can answer the question regarding your name, which they can run on their computers in a few minutes anyway....
I would definitely find out about it for your own local area and then be better prepared next time...

A lot of talk about filling out ‘forms’. Cops seem to do a lot that.
Well if the form has a spot for everyone’s DL then I guess we have no choice. Better just supply whatever the form requires.
No but I found it interesting that 2 underpaid, overworked cops had time to grill me about something that was purely an accident and which I never tried to conceal.
I took the MMPI many years ago at a Christian counseling session, part of something that was recommended by a pastor for improving marriages. Anyway, so we went there and I remember the guy asking if I was a Christian or not (well..., it was a Christian counseling place...) and I said yes. He said he had to know that so he could “adjust” the scores, or it would make it seem that I was “off” otherwise, as it was biased against Christian thinking and answers...

Most states have a specified dollar limit that's used to determine if an accident/police report is required. A simple little dent with scratched paint can cost $2k when a dealer "does it right" and refinishes a whole fender. It also doesn't matter if the damage occurs on private property. The report is still required when the damage excedes the statutory $ amount.

The person can easily carry a piece of paper saying, “I am so-and-so. Call this number in case of emergency.”

yeah, that’s much easier than simply carrying an ID.
Carrying ID is a different issue than being forced to show it anytime a cop feels like it.
insurance fraud is a big concern nowadays. look, i wasn't there, but come on. it is so STUPID to call the cops for help and then stonewall them! you called them! let them do their job properly.

No the cop stopped speaking to me after I called her on not needing my license and gave it to her anyways. My wife is in agreement with me.
Far as being a jerk, my rights are a lot more important to me than being polite.
There is some confusion there. Neither my wife nor I called the police. The owner of the other car called the police.
but if everyone agreed to call them, there should be cooperation.
