first up tuesday was monroe asking the court be cleared to consider the matters relating to the ‘impaneling of a jury’.
Anna’s mother, Virgie Arthur, is NOT on the witness list, but says she expects to be there, ‘every day’, and attended today with her husband, James Arthur.
Birkhead, who apparently IS on the witness list, says outside the courtroom that maybe what he has to say might even help HKS

According to our sources, Stern testified for about five minutes around 11AM EST.
Stern was reportedly asked two questions:
-Did you know Daniel Smith?
-Did you identify the body in the morgue?

also, a poster previously reported that Stern volunteered info about pictures taken of Daniel without being asked
The attorney general’s office said Stern may be recalled as a witness for further questioning, according to AP.

“The second witness, Francis Woodside, a nursing assistant, told the court that when she went into Ms. Smiths room the night before her son died there were three persons in the room along with the patient and her baby Daniel Smith, Mr. Stern and a “white headed gentleman” that she could not identify by name.
“Ms. Woodside said she entered Ms. Smiths room three more times during her 11:30pm to 7:30am shift once to deliver three pillows, another time when Ms. Smith requested pain reliever and the third time, around 6am, to take the patients vital signs.

“The third person called to the witness box was registered nurse and mid-wife Janice Knowles. She testified that she last saw Smith alive at 5:30am on September 10, 2006, when she came to take the baby out of the room and into the nursery.
“Ms. Knowles testified that Smith did not want the baby to leave and protested to his mother, but to her recollection the baby was taken out of the room.
“Next to take the stand was Mavis Davis, a certified phlebotomist one who draws blood. She told the court that she last saw Smith alive around 6:20am when she went to draw blood from his mother.
“I saw a young man making adjustments to her (Anna Nicoles) bed,” Ms. Davis said.

Says Michael Von Zamft, an assistant state attorney in Miami familiar with the investigations into Daniel's and Smith's deaths: "There is a lot here that is questionable. The son dies; she dies. ... And Stern was around at both times."
