TMZ has obtained the official copy of Anna Nicole Smith's will, filed moments ago by Howard K. Stern.
The petition to probate Anna's will was filed in Los Angeles County Superior Court. It is the same will that was discussed during the contentious Florida court hearings. The will doesn't name Larry Birkhead as a beneficiary, but the petition to probate lists him as a party with an interest in Anna's estate.
TMZ got in touch with Ron Rale, one of the named executors, who confirmed that Birkhead has filed a petition to become the guardian of Dannielynn's estate. Of course, you recall, a DNA test confirmed that Birkhead is Dannielynn's daddy. Rale added, "Contrary to any speculation, there is no way in the world that there is any petition to name Larry as a beneficiary of the estate in his individual capacity."
Rale also noted that in the petition, Stern waived any right to compensation as executor.
In the will, Anna is listed to have had personal property valued at $10,000 and real property valued at $1.8 million when she died; however, she still had a $1.1 million mortgage.

I'm not sure I buy Ron Rale's excuse that the date was wrong on the Fax Machine. I don't believe this type error would not have been caught earlier than 5 days in a firm the size of Trope & Trope!

That FAX date is proof positive for pre-meditation. If there was a date malfunction - ALL THE FAXES PRODUCED BY THAT COMPANY WOULD BE OUT OF SYNC.
That should be considered evidence of criminal intent in Jerry Brown’s investigation.

The lawyer for Smith’s mother asked Stern why his lawyer faxed a copy of Anna’s will five days before she died. TMZ obtained a fax cover sheet showing that Ron A. Rale, Stern’s lawyer faxed the will on February 3, 2007. Stern, who acknowledged the story had been reported on TMZ, first said the date on the fax must be a mistake. He added that he didn’t talk to Ron Rale about Anna’s will until after she passed.

The otherwise brilliant attorney did not notice the date error? First thing he should have done was call Rale and tell him to fix his fax machine and send another one. Trouble is - he didn’t - because he couldn’t - there was no fax machine error to fix. That beautiful truth just slipped past his lying eyes.
If the date IS a lie...which Barth attested, too...she set herself up as a witness.

It is important to know that Rale’s big explanation was he faxed it from HOME! And.. that phone number is from three house ago.
What is interesting about THAT lie is, why was the date not off by THREE HOUSES AGO??????

Bald Truth Exclusive: Cosby Publisher Wins Delay! Read The Letter Here!

In a Bald Truth exclusive, we’ve learned the powerhouse New York law firm defending Rita Cosby’s publisher in a $60 million libel suit today won a brief extension to respond to Howard K. Stern’s request for an order banning Cosby, or anyone else, from trying to influence any witness or tamper with any evidence.
It must have been the eloquent, Oct. 22nd letter from attorney Doug Maynard, a former federal prosecutor now with Akin Gump– and obtained by The Bald Truth cosby-publisher-10-23-ltr-to-judge.pdf — that persuaded U.S. District Judge Denny Chin to grant the defendants’ lawyers until November 13 to respond to Stern’s complaint. In it, Maynard complains Stern lawyer Lin Wood has been kind of like Waldo, MIA and impossible to reach.
Hey, we totally understand, since Wood hasn’t had time to call us back either. We hope it’s nothing personal.
But we DO know he was in court last Thursday when the judge indicated he was troubled by transcripts of Cosby allegedly trying to pay two Haitian nannies for an affidavit.
In fact, Wood was so disturbed by the audiotapes of Cosby, secretly recorded by a lawyer for the women, he attached the transcripts as an exhibit to back up Stern’s request that the former FOX host and MSNBCer be ordered to stop trying to talk to witnesses like the nannies she concedes she never interviewed in the first place– to back up her reporting about an alleged gay sex tryst between Stern and Larry Birkhead.
That’s perhaps the most salacious anecdote she lays out in her book, “Blonde Ambition,” the target of the libel suit filed by Stern against Cosby and her French publisher, Hachette.
So far, the publisher says it will vigorously defend the suit and stands by her reporting on the gay sex charges (and everything else) — vigorously denied by Stern and Birkhead.
Last week, both defendants agreed to an order prohibiting any party from attempting to influence any witness and requiring everyone involved to preserve all evidence. But lawyers for Cosby and the publisher also argued that there was no need for expedited discovery because they had agreed to the order.
Judge Chin gave them until Wednesday, Oct. 17, to submit briefs on the issue. But the night before, Maynard writes Wood agreed to give him more time to respond, especially since Wood planned to file an amended complaint, then changed his mind.
Still, delay or not, the judge did agree to fast-track discovery, and gave both sides April 18 as a deadine–and the date for a pre-trial hearing.
According to those in court, the judge said he found the Cosby transcripts very “disturbing,” and that, if accurate, they suggest the newswoman tried to interfere with witnesses.
Cosby’s attorney, Elizabeth McNamara, responded that she had no reason to believe the tape was manufactured, but said when all the tapes were reviewed, it would be clear that Cosby would be cleared of any appearance of wrongdoing.
Cosby claims her Nannygaysex source is an investigator who heard Anna’s employees relate the tawdry tale of the former Playboy centerfold laying in bed watchiing her favorite all-boy tape. On a recent talk show, Don Clark, former FBI agent turned private eye for Virgie Arthur lawyer John O’Quinn, denied he was the source. He did tell Geraldo that he heard the nannies tell the same story when he met with them in the Bahamas. Only…the women deny it and so does their lawyer, Elizabeth Thompson.
We’ve also learned there was another investigator at that meeting in the Bahamas who works with Clark, Wilma Vicedomine, of Houston. We’ve tried e-mailing Wilma, who goes by Wilma Vice, hoping she’ll relate what she heard, and whether she’s the mystery PI Rita claims as a source for Nannygate…but so far, no response.
We’ll have more on some of the colorful, mystery players who keep emerging in this sordid tale, so stay tuned.
I have to go back and look at my notes (not easy to do, they’re just in numbered files chronologically, like looking for a Swiss bank account, lol) so I can speak about the Rale fax better ... but, until I do ...
I thought the argument in Seidlin’s court was a smokescreen. The cover sheet in question was NOT, as I understood it, when HKS or RAR faxed the will copy to Barth, but that’s what they argued and pretended to “resolve.”
I *thought* the dated fax cover was the one on the copy itself, as to when Rale first faxed it to HKS in Nassau to begin with, not when it was faxed to Barth.
HKS and ANS had no reason to even know Barth on 2-2-07. I always felt like the will request might have had something to do with the alleged Dubai trip plans, or at least HKS could’ve used that as an excuse - he always has one for everything.
Oh, also, it was faxed from Rale’s house, not office.
