Stern Shut Down Over DNA

Posted Apr 2nd 2007 11:29AM by TMZ Staff

Howard K. Stern lost a big one in the Bahamas today.

Stern's appeal on DNA testing was just rejected, and Howard K. was penalized by the three-judge panel to the tune of $10,000. TMZ has learned Stern was ordered to pay $5,000 in attorney's fees to the Registrar General and $5,000 to Birkhead's lawyer -- not Debra Opri, the Bahamian one.

This could clear the way for the unsealing of the DNA test results -- that should happen in court this week.

Typically, these penalties (called "sanctions") are imposed when an appeal is frivolous.

Story developing...

He was sanctioned because his appeal was "frivolous"???

I love the Bahama judicial system...!!!

There goes one card falling down from Stern's house of cards. I hope and pray the laws of physics act predictably.

CNN has a different take:

NASSAU, Bahamas (AP)

-- A Bahamian court on Monday refused to prevent the release of DNA results that could reveal the father of Anna Nicole Smith's daughter.

A three-judge panel of the Court of Appeal rejected a challenge filed by Howard K. Stern, the lawyer-turned-partner of the Playboy playmate who died February 8 in Florida. http://www.cnn.com/2007/LAW/04/02/smith.dna.ap/index.html

No mention of appeal "withdrawn".
