Anna Nicole Smith has died according to ABC News

Anna Nicole Smith collapsed in her hotel room at the Hard Rock Cafe and Casino in Hollywood, Fla., and was rushed to a hospital on Thursday. A Hollywood, Fla., fire department spokesman told MSNBC TV that the actress was unresponsive when the rescue unit arrived on the scene.

Sources confirmed to Access Hollywood that Smith was transported to Memorial Regional Hospital shortly after 2 p.m. EST on Thursday. Access Hollywood also is reporting that Smith was intubated at the scene.

Officials told the Miami Herald, "it does not look good."

No matter what happens, in time, both bodies will return to the USA. The important thing is that Howard did not get complete control of the body, cannot stop Virgie from seeing the baby, cannot stop the DNA process, and cannot stop the probate of the will.

He's lost most of his power already.

They were out at sea in a boat...ANS jumped overboard so it couldn't have been very deep.

Were they in international waters, Bahamian waters or within the US shoreline?

What is that jurisdiction? 20 miles offshore?

How often does it occur that bodies are up for grabs and that the "intention" of the deceased is a primary consideration. If that were the case, bodies would NEVER be reinterred.

Maybe that is the latest Hollywood fad now. James Brown's body is still laying around above ground.

I heard someone say on Imus yesterday morning that:

so from henceforth all cases of this sort in Fla. will have to appoint a guardian ad litem for the underage child and there will be precedence that a guardian ad litem will have UNLIMITED powers as to what to do with the body....that's the message I got

And all the wannabe Florida lawyers are rubbing their hands in $$$ glee at the vision.
Will this now go to Florida Supreme, ya think?

Jurisdiction is different all over the world. It may be only 4 miles in the Bahamas.

We don't know if the jumping in the water was IMMEDIATELY after the ceremony...just prior to docking. There are ebb and flow laws and the line may be not exactly where we think it is or should be. She may have been in the water or considered "on shore" despite what we saw.

I think the Texas lawyer's did not do a very good job of creating a record in the lower court to show that ANS's intent was not very clear at all since she had a great deal of difficulty burying Daniel in the Bahamas (40 days lapsed) and that she, in fact, preferred that he be buried in California. But, HKS bought the plots and the deal was done.

Also, they should have done a better job of showing that while ANS may have wanted to be buried near Daniel it had nothing to do with the Bahamas. This is where more testimony should have come in about the distinct possibility of moving Daniel.

Finally, they should have shown, given the high probability of DL living in the USA and NOT in the Bahamas, that it is in DL's best interests to have her mother (and brother) buried in the USA.

I think when the one appellate judge said it was in DL's best interests to be able to visit her mother in the Bahamas, it showed a lack of knowledge of where DL will most likely be living in the future and completely ignores what is truly in DL's best interests.

Virgie needs to quit. Anna is going to be buried in the Bahamas. I don't think for one second Daniel would have wanted to be buried there but Anna made a mess of everything.

Again...Horizon's ownership is in dispute. And to be a legal resident of the Bahamas she must have property ownerhsip (from what I have read here).

I still think the panel of judges asked about the timing of the funeral to determine how much (perceived) time they have to issue their ruling.

No lawyer here, but I can't see how they can get past the GAL have broad discretion, and the setting of precedent that GALs will now have to be appointed per this case (if they rule that GAL can make final determination).
