Anna Nicole Smith has died according to ABC News

Anna Nicole Smith collapsed in her hotel room at the Hard Rock Cafe and Casino in Hollywood, Fla., and was rushed to a hospital on Thursday. A Hollywood, Fla., fire department spokesman told MSNBC TV that the actress was unresponsive when the rescue unit arrived on the scene.

Sources confirmed to Access Hollywood that Smith was transported to Memorial Regional Hospital shortly after 2 p.m. EST on Thursday. Access Hollywood also is reporting that Smith was intubated at the scene.

Officials told the Miami Herald, "it does not look good."

Ohhhh, this is getting interesting. Kapoor is in deep trouble if you ask me. The State of California has no compunction about going out and arresting doctors in their offices, in front of patients, if they have been shown to violate rules of prescribing class three narcotic drugs.

I wouldn't bet on Milstein doing anything about cameras. The burial is in the Bahamas. Stern will stay in the Bahamas. If he breaks the Florida court order, Florida would have to drag his butt out of the Bahamas before they could actually do anything to him like sanctioning him.

So you didn't just hear Barth's explanation for HKS not giving the DNA sample? It was that up until ANS death, all of the paternity action was with ANS, and Barth's client, HKS was not even named. HKS hasn't even been given five minutes to grieve, before people were pointing fingers at him, and telling him to get a DNA test. She is quite sure that LB and HKS are going to work this out together, the best thing for the child, without all "our" involvement.

This is the most important part of this because it relates to this case. "Rise" is the keyword here. "Rise" does not mean "to increase" the presumption. Because it later says NO Presumption shall be made because there is more than one father claiming the child as theirs.

Does this mean I am wasting my time? I was pretty sure my time spent here would make a difference. You know, kind of like my time spent anywhere else. I'm pretty sure my time spent on Foreign Affairs is really going to make a difference. I bet that Iran, and Pakistan, and Russia. They will all defer to my sentiments regarding all of the world problems. What the hell have I been thinking? Wasting my time on things that other people think unworthy? Just who the hell are these other people anyways? And why should their opinion matter?

Well, they just announced that Opri is intervening in the Bahamas custody case on Monday, so I suspect she's not buying it.

Cathryne Cryer is worried about Rale arguing that the commitment ceremony is an actual marriage in the Bahamas. She asked Ron Rale the question, and he dodged it. Cryer brought it up again at the end of the show. This has been worrying me for days, and it's where I was afraid this was leading.

Yes, I heard that. If he had not been selling pictures left and right I might have a little more sympathy for the man. I'll see if he really does work it out with HKS, but the Trimspa guy made it sound like the chances of that are nil and none.

Application for declaration of paternity.
(a)
being a woman, alleges that any named person is the father of her child;
(b)
alleges that the relationship of father and child exists between himself and any other person; or
(c)
being a person having a proper interest in the result, wishes to have it determined whether the relationship of father and child exists between two named persons,

may apply in such other manner as may be prescribed by rules of court to the court for a declaration of paternity, and if it is proved to the satisfaction of the court that the relationship exists the court may make a declaration of paternity whether or not the father or the child or both of them are living or dead.


This in there to cover the bases on:

Unmarried couple lives together. Man is raising the child in the home that the unmarried couple lives in. Man is not that childs bio-father but is now presumed the father. No other man has come forth to claim the child as his. 10 years go by and couple is still together but not married but both are still raising the child together. Mother dies leaving the child and her live in boyfriend after 10 years. (child is 10 yers old). Still no other man has come forth claiming the child as his. The live in man can now go to the courts to claim paternity on orphaned child if he desires. Let's say the man does not want the child and decides to turn the child over to an orphanage, the courts then can use the presumed father status on him and possibly can make him pay the government child support for the child being in foster care.

Is it possible that ANS delayed the DNA testing because the babies blood or mouth swab could show signs that she had drugs in her system (Danielynn's)? Big ASSumption I know. But it is possible that the baby could have been born with drugs in her system and ANS was waiting until such time as that would no longer be detectable.

ANS "delayed" (read refused) the DNA testing because she wanted to keep the baby from Larry. This is the same reason she moved to the Bahamas. Drug testing may have been a secondary reason.

Basically Larry is the "Rise" in the presumption of Stern being the father. Since Larry has come forth claiming the child is his then there is no longer a presumption that Stern is the father of baby.

Then DNA testing has to be done to determine who the true father is.

then this goes into effect...

14. (1) Where an application is made to the court to determine the parentage of a child, the court may give directions to the applicant to obtain blood tests of such persons as the court specifies and to submit the results in evidence.
Blood tests.

(2) Any directions given under subsection (1) may be given subject to such terms and conditions as the court determines.

(3) Where directions are given under subsection (1) and a person named therein refuses to submit to the blood tests, the court may draw such inferences as it thinks appropriate.

(4) A person specified in directions granting leave to obtain blood tests under subsection (1) shall be deemed to have consented-

(a)where the person is a minor, but-
(i)understands the nature and purpose of the blood tests and consents thereto; or
(ii)the person having his charge consents; and
(b)where the person is without capacity for any reason other than minority, if the person having his charge consents and a medical practitioner certifies that the giving of a blood sample would not be prejudicial to his proper care and treatment.


Larry has enough proof that bring in the "Rise" (to question) Stern's presumption of fatherhood. Because he has proof she went to the Bahamas to avoid Larry filing for DNA test on the baby and to help avoid him getting custody of the baby. Anna's track record with the house and her permanent residency permit is now coming out in the Bahamas. Anna did everything she could to keep Larry away from the baby for the last 5/6 months. There is proof of that. I think Larry will be able to win his case against Stern. But the problem if Larry wins in the Bahamas and brings he child back home to the states there is nothing stopping Stern from coming back to the states to fight for the child again within the US courts. This is why they want both the US and the Bahamas to work together on Larry's paternity case. If they do it will choke Stern off in both the Bahamas and in the USA.

I am so SICK of these Trimspa people and their operation CYA. They are only slightly less credible than HKS. These people knew (regardless of what they say) that Anna was taking downers. I don't know what Trimspa pills are but normally diet pills are uppers. What they did to Anna borders on criminal as well. They disgust me. And claiming to be her friend! Uughh! Please! Anna was their cash cow (sorry).
