I don't know if this has already been posted, but here's a video (from tmz.com) of ANS, HKS, LB, and Anna's methodone doctor partying together in a gay nightclub. HKS and LB are looking on as a shirtless Dr. Kapoor gropes on Anna. http://www.tmz.com/tmz_main_video?titleid=525667829 (the video takes a minute to load) LB isn't the decent man he's tried to present to the public.

I don't know of any real man who would repeatedly have unprotected sex with a drug addict. Nor do I know of any real man who wouldn't blow the whistle if the 4 months pregnant mother of his child was in the hospital detoxing and taking prescriptions at the same time.

IMO, every single player in this pitiful drama is slime. This baby may have been born with permanent brain and neural damage from her mother's use of narcotics while pregnant...possibly the baby was born addicted as well.

I don't really care who gets custody of ANS's decomposing body, where the body is ultimately buried or who the sperm donor of that baby is. I don't see any hope for the baby to ever have a chance at any kind of normal life unless she's removed from the custody and influence of every one of the sickos who've appeared in this circus of a trial.

>>>Why do I have a sinking feeling that toad is going to win and keep the baby?
Because you know deep down that that would be the correct decision? Just a guess...>>>

Look Mr. Rum Tum Tugger, just because you are sexiest cat out there in Cat World, doesn't mean you know Jack.

That baby does NOT belong to Howard K. Stern.

I'd like to see Howard arrested in hand-cuffs, if he doesn't let the baby be tested SOON.

I posted my thoughts on that, once - but they are so tight-lipped in The Bahamas, like Brits - no publicity while a trial is underway - that I'm not sure.

I'll try to piece it back together.

Birkhead Takes Stand, Lawyer Faints in Anna Nicole Hearing

by Gina Serpe
Thu Feb 22, 5:54 AM ET

Los Angeles (E! Online) - On the last full day of Anna Nicole Smith's next of kin hearing, the conversations in the courtroom became increasingly heated—and increasingly outside the scope of what the hearing was called to accomplish.

Following a marathon day of testimony in which Howard K. Stern, Larry Birkhead and Virgie Arthur all took the stand in the battle for Smith's body, the parties returned to the courtroom Thursday to wrap up their arguments over whether custody of Smith's remains should be granted to Stern, who is seeking to bury her in the Bahamas, or to Arthur, who wants to bury her in Texas.

The circus-like atmosphere of the day was bolstered by not only the climactic fainting of a lawyer, but by a barrage of down home assessments of the proceedings from Broward County Judge Larry Seidlin.

"I want to keep this dignified," Seidlin said. "You lawyers are trained to look for the smoking gun. Who's the villain? Who's the hero? There's black, there's white and there's a lot of grey in this case."

Seidlin kicked off the hearing by letting all three parties—"Mama," "Larry" and "Stern"—and their respective legal teams—"Texas," "California," and "Florida"—know his train of thought entering into the final day of testimony.

Over an objection from Stern's attorney, Seidlin referred to Stern as "maybe an enabler," asking, "Is he a bad guy?...These folks may not be bad. They may not be living the perfect life, but that's for other people to decide."

"I have not concluded anything yet. My mind is completely open."

Seidlin also attempted to broker a peace treaty between the different legal teams, by waxing metaphorical on Smith's life.

"Anna Nicole loved Marilyn Monroe," he said. "Camelot. Knights of the round table. One for all, all for one. Loyalty."

His confused, if well-intended, statement was quickly shot down by Birkhead's attorney, Debra Opri.

"You want the three of us to hold hands?" she asked. "It ain't never gonna happen, your honor."

Birkhead resumed the stand and began testifying about his relationship with Smith, saying that she suffered a miscarriage a year before getting pregnant with Dannielynn. He also testified that Smith pushed him out of her life after an argument which, he claimed, was inflamed by Stern to the point of disrepair.

Birkhead went on to claim that in May 2006 he was bombarded with nearly 200 phone calls by Stern, badgering him to stop publicly asserting that he was the father of Dannielynn. Birkhead finally agreed to Stern just to "get him off my back."

Despite vehement objections from Opri, Stern's attorney, Krista Barth then read off a series of angry emails sent by Birkhead to Smith in the wake of Dannielynn's birth in which he accused her of cheating on him, even going to far as to reveal Birkhead's personal email address.

"This is so off the base of the burial intent," Opri said. "We are on such a limited amount of time."

Barth later presented a contract signed by Birkhead in January 2006 in which he agreed not to speak to the press about the pregnancy, a document he claimed he signed under duress, after Smith reportedly threatened not to let him see either her or the child if he didn't sign.

Opri again objected, saying the document was likely only being entered into evidence to lay the foundation for a breach-of-contract suit Stern might file in the future, saying it was "beyond the scope" of the current hearing.

In getting back to the point of the hearing, Seidlin asked Birkhead point blank where he believes Smith should be buried.

Birkhead said that Smith should not be separated from her son, Daniel, but that the boy "considered California home, and so did Anna. For them to be laid to rest in a place that was unnecessary for them to be in," Birkhead said, wasn't appropriate.

With Birkhead still on the stand, and the clock running out, an argument broke out as to whether Seidlin would enforce an order from the California court with regard to the DNA testing of Dannielynn. Amid objections from Stern's camp, Opri & Co. said that Seidlin had the right to order the tests.

Richard Millstein, the guardian ad litem appointed to represent Dannielynn, stepped in, saying that enforcing the order was outside of Seidlin's jurisdiction and that Opri was not only "muddying the waters," but "wasting time."

"We're not gonna head that route," Seidlin said, nevertheless telling Opri, "I like your style."

"I want peace on earth here. Don't let my smile...know my insides are tough. Don't test me anymore. Don't test me. I can fight a 10-round fight."

Opri then cross-examined Birkhead, giving him a chance to repeat his belief that he is the father of Dannielynn and that he is willing to take any tests to prove it.

A Houston police officer, who also served briefly as Smith's bodyguard in 2002, took the stand and testified that Smith was a "normal, everyday loving person" who was under an enormous amount of stress. He also said that her relationship with her late son was strong and that he meant "the world to her."

He also testified that Smith thought of Texas, where her mother wants her remains to go, as "nothing but bad." He further claimed that she told him if anything should happen to her, she wanted to be with Daniel.

The hearing took an earlier than expected recess when one of Arthur's attorneys fainted during the proceedings, quickly apologizing for the disturbance and explaining he was a diabetic.

"Stay with me, Texas," Seidlin said. "I wanna be with you a long time from now."

On Wednesday, Seidlin announced to the court that a ruling on the next of kin hearing would come Friday morning. The decision to fast track the hearing, which was initially expected to take three weeks, was made after Dr. Joshua Perper, the medical examiner who conducted the autopsy of Smith, said that her body was decomposing at a faster than expected rate.

Looking at the video I can tell this was the same day as the photos were taken of the gay pride parade where ANS and the doctor rode together in the topless vehicle on the parade route..

Larry Birkhead was there to photograph the parade, ANS had asked him to be her personal photographer and she would be his exclusive client.

I noticed he had her dog there, too... found that interesting. I worry about the baby and but I also wonder what had become of her dogs.

Some of them will be going. I'm wondering now if Milstein has any standing in The Bahamas, as far as in court for this hearing. I'll bet not. Hmmm.

Body fight will affect fight for child

By Inderia Saunders, Guardian Staff Reporter

inderia@nasguard.com

A legal tussle for possession of Anna Nicole Smith's body in Florida will affect a custody battle in The Bahamas after legal counsels for all the parties involved were ordered to appear in a Florida court yesterday.

The custody battle for Smith's baby, Dannielynn Hope, may be pushed back from today's original date after Florida judge, Larry Seidlin, the judge presiding over Smith's body possession case, ordered the counsels for Smith's mother, her companion and the man listed as the father on the birth certificate, Howard K Stern, as well as the man who claims to be the baby's father, Larry Birkhead to be present in court.

When the attorney for Birkhead, Debra Opri, interjected that they all had a hearing in The Bahamas today at 2.00 pm, Judge Seidlin said: "We'll get The Bahamas on the phone, you're ordered to be here."

The attorney for Smith's estate, Wayne Munroe, told The Nassau Guardian that despite the absence of the other parties involved in the custody battle, there is a possibility that the court hearing may just go on without them.

"Yes! Why wouldn't it be able to [go on]? If the judge here feels that [the other parties involved] must be present then he will adjourn the case," Mr Munroe said. "I don't know what the Supreme Court judge will want or not want."

Mr Munroe stated that the court hearing would not be a paternity hearing, but he could not further elaborate on what exactly the case would involve as a judge has placed a gag order on the parties involved.

"[what will the court hearing be about?] I cannot tell you simply because the judge has indicated we shouldn't be talking about it, it's not a paternity," he said.

This is now the second week that the court battle for Smith's body continues on in a Florida Court over whether The Bahamas or Texas should be the final resting place for the late former Playboy playmate Anna Nicole Smith, who died recently in Florida.

The opposing lawyers have been going head-to-head in a Broward County Circuit Court ifor the past few days to decide where Ms Smith's final resting place should be; how much DNA sampling was necessary before her body can be released for burial; and whether or not a baby can legally be considered next of kin in the state of Florida.

Florida attorney Richard Milstein was appointed a guardian to protect Ms Smith's five-month-old daughter, Dannielynn's, interests. Attorney Shane Kelley was appointed to suggest to whom the body should be consigned, and where it will be buried.

Gretta has had them on (last week). I don't remember the names, but they seem to really know Bahamian law front to back. Good sign. Hearings there are closed (as in Aruba).
