The reason this may not be a smoke screen, as someone else mentioned upthread, is in court when RS's alibi was mentioned Nifong made a smirking response about the defense not know "his" timeline. I think this has been planned since RS alibi information was made public. I think Nifong's got a legal duty to reveal "his" timeline, doesn't he?

I don't know if the pension of a DA, a state employee, is determined the same way that retired teachers' pensions are, but it it is, the Nifong's desire to have a higher paying job via election for his last years before retirement is understandable.....the last 4 years of pay (presumably the teacher's/DA's highest pay) determines the amount of the pension.

Long ago, the defense put in a motion asking for a "bill of particulars" which would have required Nifong to do just that. Nifong made some nasty remark about the three needing to account for themselves for about two hours one night and it was too bad if they couldn't do that. The motion was denied but the judge left open the option to refile it.

The question now will be why he didn't drop ALL the charges in December. Maybe he feels that would open him up to a lawsuit for malicious prosecution--and that the risk of such a suit will be lower if he takes it all the way to trial, even if the kids are acquitted.
Just a wild guess. I'm not a lawyer.

If the consequences to those boys weren't so bad, this whole thing would be hilarious!
It does seem like there should be certain requirement, doesn't it?
I keep thinking she's decided to go back and write a prequel, not quite understanding that you can do that in books and movies, but it doesn't work so well in a courtroom.
She's not an English or Creative Writing major, is she???
