You may, or may not, be aware, but any educational institution has the right to insist the students in its care make written statements that may turn out to be not in the student's best interests. David Evans admits he cooperated with the officers, as we have all taught our children to respect authority. You can see the result. Your children MUST be instructed to make no statements and INSIST that their parents be contacted.

He didn't ask for a bench trial. There is no right to a jury trial for a misdemeanor. He couldn't have asked for a jury trial if he wanted one.

Wanna' bet? I'll take your money -- God knows after what they did to us, we need it. They do so with impunity every single day. Talk to the people who have to figure out what to do with the kids who've been booted out of school? Even our attorney said the law is very grey in that area. He mumbled something about custodial rights. Sounds like a violation of civil rights to me, but what the heck do I know.

I didn't read the fine print, I thought you got due process with your membership in this country -- unless you're under 18 or still in school. Read the fine print -- our system is broken.

and since it was perfectly clear that the conviction was a done deal

And let's not forget that the ONLY reason he was back in that court was because of Nifong's bogus indictment.

You are correct as to the facts of this case. My comment was about the life changing effects for the subject of any false rape accusation. I think we can all agree that the Duke case is an aberration of the CJS.
(At least I hope it is!)

Let me go on to say, your children must be instructed to insist on it. The administrators won't volunteer it, but you child can INSIST on their parents being called. TELL YOUR CHILDREN, WARN THEM that not every adult is interested in their welfare -- just like strangers -- be very careful.

Precisely.

I always thought the same thing and taught my son that; UNTIL I became a court reporter.

Now I tell EVERYBODY not to say a word until you have legal representation.

And I do mean even in car accidents!
