Whose refusal? Liefong's? The cops'? Either way, no, highly unlikely. If you mean at trial, then yes, it would be a violation of due process most likely.

So indictments without speaking to the accused, even if the accused requested an interview, is not a violation of any rights? I guess this is the way the system works--it just scares the heck out of me.
