Burke's comments are a bit of a mystery, but clearly he knew something wasn't right. It's almost like he didn't know, or was pretending not to know, the full extent of what happened to Jonbenet.
As for the timing, yea, it seems really unlikely that the coroner would pin the time of death to around 10 p.m. and the body would already have an odor by lunchtime if she was killed much later than that. Beyond that, I have no idea what happened. It just seems that she was killed in the full knowledge of the family.
John, Patsy and Burke couldn't possibly have been in bed in their rooms before 11 p.m. So they were very much awake and moving about when this happened...it would seem.

The courts have ruled numerous times that any statements made while in a 'voluntary' state of intoxication are admissible.
It would prolly be a gray area, but I'd sure make sure the stewardess/cabin attendant or who had control of booze was in close attendance, all the time.
I know we have a few lawyers here so here goes the pings.
