I am a bit curious who the defense source is and when did this source "leak?"

What stake does Benjamin Niolet have in this story?  Why would he recycle old news as new news?  Did he actually speak with a defense attorney or did he pull this information from the pressers the defense lawyers gave months ago?  Did he write this story as a way to raise the ire of Judge Titus?  Does he want the good judge to think his gag order was violated?

Rotten fish is what this smells like.

Is the outrage toward Nifong really there, but there's no organization through which to express it? Or are the locals a complacent bunch likely to sit the election out?

"Why people might find out how anti-racist the Finnerty family really is. They might learn about all those family charitable contributions that primarily benefit blacks. Worse, they might not only appreciate that the "hired priest" libel is shameless Catholic bashing (that priest being a friend of your father since childhood and someone you've known all your life), but that the priest was called to build a hospital in AFRICA and lots of the money for that noble purpose came from the Finnerty family. It would be very hard to have Durham's blacks hate you if they saw you and learned how you were raised and what you and your family believe. Why, it would be impossible to brainwash the bulk of Durham's blacks under those circumstances."

Thanks for posting that article. The Finnertys seem like really good people. I think Gaynor is a little early though. According to his arrest records, Collin's birthday is Sept. 10th.

What do you think about Gaynor's advice?

The guys can't talk now because of the gag order.

But I think some UNINDICTED players might be able to speak out.

All that is necessary is that they don't help Nifong figure out who was at the party, and when. But they CAN talk about press coverage, the decency of the three indicted players,
the unfairness of the Durham crowd, etc.

Gov. Mike Easley today said the scandals swirling about House Speaker Jim Black, a fellow Democrat, are a "blight on the state."

Easley did not respond directly to a question by reporters about whether Black should step down from his post. Former state Rep. Michael Decker admitted in federal court on Tuesday that he switched parties three years ago and supported Black for another speaker's term in exchange for a legislative job for Decker's son and $50,000.

"It's a blight on the state," he said. "There's no need to pretend that it's not. I commend the prosecutors for moving aggressively, moving rapidly. I hope more information comes out sooner rather than later and we get to the bottom of it."

Well, let's say he could legally make a statement. Should he? I don't think so. In the Duke Chronicle article his teammates said he isn't doing very well so I doubt he needs the stress. Also I don't think anyone should reveal the details of his alibi. Keep Nifong in the dark about it - it's probably making him crazy.

Miller mulls resignation in wake of fraud charges

News & Observer | 6/09/06 | Nikole Hannah-Jones

State Rep. Paul Miller said Thursday that he has not decided whether he will resign his seat in the General Assembly after his arrest on felony charges of attempting to defraud the U.S. Department of Education.

Floyd McKissick, chairman of the Durham County Democratic Party, said Thursday that he intends to have a "heart-to-heart" talk with Miller about whether Miller should serve voters while facing criminal charges in U.S. District Court.

"They are extremely serious charges," McKissick said. "[Miller] is innocent until proven guilty. ... He should be allowed the privilege to continue to serve. [But] I think that for those who are in these high-profile positions, they really need to think about the good of the Democratic Party and their constituents."

According to the criminal complaint, Miller altered copies of five checks originally submitted for $100 each in 1992 to make it appear that he had made payments totaling $20,500.

He is serving his third term in House District 29, which serves part of Durham County.

In some places on the Net, they are discussing the DNA - and really seem to be unaware that Dan Abrams and Susan Filan said the men DID ejaculate. Abrams and Filan said that when you read the woman's description of the 'attack', it's unbelievable that there was DNA found on or in the woman.

Of course, the overwhelming majority of people have no idea, because the media has done an excellent job of keeping a lid on the incredibily damning information. It seems they are absolutely sold on the fact that the woman "deserves" her day in court.

The normal procedure would've been for the other networks to pick up on the information diseminated by MSNBC / Abrams. Instead, every network, including FOX, neglected to report that the entire discovery file was reviewed by MSNBC / Abrams and that Abrams' and Filan's conclusion was that the woman's description of the crime was unbelievable when juxtaposed with the DNA reports included in the discovery.

I screwed that all up. It should've read:

Abrams and Filan also called into question how it could be
that the AV's DNA was also absent from the Rug and floor in the bathroom.

I think that this strategy by his defense attorneys is totally correct. Nifong somehow must put Collin in the house and has know idea what exculpatory evidence that he is up against. All he has is the id from a lying whore and her partner who described the 6' 3" over 200 lb lacrosse player as the little skinny one. Doesn't sound like much to go on there. No DNA, no video, no pictures. Only lies by two very suspect individuals. Then after the defense shreds their testimony they get to present theirs. I have felt all along that his might be the most airtight. Possibly could include the only black player as a witness to his whereabouts. Just my thoughts.

1. I find this pathetic. The Finnety's opinions should not play into this one way or the other. They should not stoop to making this argumnet.

2. The Finnerty's child is now more valuable to the race baiter than any charity they could give so any past charity is meaningless. There is a lesson in this.
