Wow

I have a stepbrother doing 5 years in a VA State Prison for date rape.

When my sister said he was in prison for rape but swears he did not do it, I thought "Yeah right, that's what they all say." His dad married my mom after I had married and left home..there was no close emotional bond, no emotional prejudice towards believing him.

After reading some of the transcripts and the motion for a new trial I could not believe anyone would be convicted with such a flimsy case.

He lived in Harrionsburg, had a girl over one night and they had sex. Took her back to the dorm the next morning and waiting for her was her boyfriend.

He was not even charged until a year later. His mistake was that he did not take this seriously...I think he got his lawyer from the phone book based on legal fees instead of experience.

She claimed a date rape drug, but how in the hell she remembered all of those details (Lord, they did things I never knew exsisted) if she was drugged is beyond me. Her theory was the drug was in the glass of water she asked for. BTW, she had the wherewithall to take her contact lenses out before the sex, drugged no less.

Forensics? Their evidence makes Nifong's look like it was processed at Quantico.

My theory (and I went from not believing him to believing him based on the court records) is that her boyfriend, er, fiance, demanded an explanation and she did what av did, lied like a rug.

He was arrested one year later and went to trial about 6-9 months after. In that time, she had convinced herself it had happened. She was a psychology major at Bridgewaterat the time and now lives in Baltimore.

The motion for a new trial was denied and someone advised him to serve out his time because an appeal would take longer than his sentence and would cost him a fortune.

(Thank God he is in about as safe a prison as can be-nothing like Lorton)

No one in the family has any doubts about his innocence and we are known for being brutally honest with each other at times.

When I say she has convinced herself her story is true, I say it meaning "That bitch actually believes her lies." I am truly angry. But my family has this thing with anger so with a sigh they say "It is so obvious she is lying, but she believes what she is saying."

LOL, that is when I shake my head and wonder if they found me in the pumpkin patch, could we possibly share the same DNA? Anger is a normal emotion, you don't "get over it" you resolve it.

But yes, regardless of what the Nancy Graces and Wendy Murphy's of this world say, women lie. Women lie about rape. The human condition being what it is when someone's back is against the wall they will do one of 2 things, tell the truth or lie. And we all know not everyone choses truth.

I'm familiar with a case in jacksonville -- see the documentary, "Murder on a Sunday Morning" -- in which the police actually destroyed records, ripped pages out of a bound log book.

The city wound up paying through the nose.

How can Susan Filan defend this? She should not be taken seriously. She shouldn't be a viable guest any longer.

She makes the show unwatchable. I'm going to write a note to Tucker@msnbc.com suggesting he not have her on. She's nothing but a mouthpiece for Nifong.

Haven't moved yet. I was told by a lawyer the database will follow me (only if I have interactions with authorities though).

I don't shoot fireworks and make sure my dog has her rabies current. Don't jaywalk.

yes. In reading on the subject (which at one time I had zero interest) many false reports are made to get attention from a man. Or like Tawanna Brawley to explain a consensual experience.

Taking the documents and reading them closely is the best way to go. Examine the evidence yourself

Having 3 sons I have been known to dispense a bit of advice. One thing I have always told them:

"If you are ever arrested (and you damned well never be or I will kill you) never, ever talk to the cops. Keep your mouth shut. What you do not understand is that cops can lie to get you to say what they want. It is the way it works. Say I want a lawyer or I want to make a phone call. And for God's sake never talk with your new roomates."

And then I say don't call me. No way, no how am I bonding you out.

Fortunately, I have good kids although my middle son was touch & go for a while. He found out Mom will not bail him out...DUI. I made him sweat it out for about 36 hours. I finally picked up his paycheck, took it to the jail, had the cops give to him to sign, cashed it & he bailed himself out. I didn't pay for a lawyer either..so he had to do 3 weeks at the end of his probation. Oh yeah, did I say I wouldn't lend him his probation fees? I'm a hard ass Mom.

The prosecutor doesn't have to call the accuser, but if he doesn't, the defense will and she will have to testify. Remember, a defendant has the right to confront his accuser.

The interesting thing about that exchange is that Tucker pressed her to present ANY case, and all she could do was rail about defense spin and how witnesses like Kim could be discredited. But she never actually presented a case, other than to assume that the defendants have hte burden to prove their innocence. The reason she never was able to respond to that (other than shrieking) is that THERE IS NO CASE.

This whole case is a disgusting lie, and a writ of habeas corpus may be in order.

And Brodhead climbed into bed with these people instead of giving his own studnets the benefit of the doubt.

There's nobody running against him so, unless the Republicans field a candidate who must file by 6/30, the job is his without an opponenet to face in November.

I'm not sure I understand your second paragraph. If DUMC said there was no rape, but NCU said there was, which apparently they didn't, Duke would be chastised and vilified. But if UNC hospital agreed with Duke's findings, then Duke would be off the hook. So, how would going to UNC shore up Mangum's story? I'm not following your reasoning.

I've read your story a few times trying to put my husband in your shoes. I can't fathom the frustration you must have felt and the pain your family endured. You and your family must be incredibly strong.

Not to shore up her story, but Nifong and the Durham PD knew that the Duke medical report would not support the sensational allegations she was making. Miraculously, she appears at the UNC Hospital the next day (we don't know what they said, other than Crystal telling them even different stories about what happened).
