Police: Dancer Called Rape Allegation a 'Crock'

The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. Osborn suggests that could be the source of the vaginal injuries mentioned in the rape kit report. (snip) Osborn says the accuser gave conflicting accounts of what happened. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.

The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.

She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

But how about the stripper's story? She charged Kim as a participant in the (non) rape, so doesn't Nifong have to charge Kim?

By not disclosing it to the defense. The only way for Nifong to avoid disclosing it in discovery is if he doesn't have it in his possession, and the only way to not have it in his possession is to tell the investigator or his supervisor not to give it to him, whether he says it directly or implies it indirectly through another person or through deed. These facts revealed in these reports are far too important for an investigator to make the decision to not include them as a matter of his own discretion.

yeah, I am smart enough to know that most people representing the police dept are not like that and are great people putting themselves at risk.

I have that antenna now that is on guard for the false accusations and Railroading that follows in some isolated cases.

It probably just a coincidence that my experience was in North Carolina too. These people have tremendous public trust, it's easy for people like the DA to abuse that position.

He avoided the exculpatory evidence the defense wanted to show him before he secured the indictments because he did not want to be aware of it when he presented the case to the GJ. He avoided receiving the reports from DPD now in question because they are also exculpatory in the sense that they devastate Mangum's entire presentation, because he didn't want to have to turn them over to the defense in discovery.

The guest is right! Of course, the hookers don't have any money, but the defendants should sue Nifong and N.C. and demand that the accuser be prosecuted for ALL if her crimes.

But the most significant things that not charging Kim reveals is that Nifong didn't believe Mangum himself and he also never figured on the defense getting those reports.

Nifong could be in trouble, especially if the defense starts moving this outside the realm of stste court. i expect they will wait a bit to see if Nifong files a response to the motion. he doesn't have to, but he should. if he doesn't, it speaks volumes and, to my mind, shows a consciousness of guilt on his part to hide this new information conatined in the DPD records.

Brilliant work by the defense, most particularly in getting an order securing those LEA records.

I know that defense attorneys have the option of whether or not to allow their clients to take the stand during their trial.

Is the prosecutor required to put the accuser on the stand or does he have the same option as the defense attorneys re this matter?

He wanted a white on black crime. The actual election is in November and he is not going to do anything until then. This case was always crap and he knew it but it was as close to white on black crime as he was going to get.

I'm curious about her going to UNC hospital though. Remember in that ridiculous form they had at NCCU where someone stood up and said that if Duke hosp said she wasn't raped they only said it because it was DUKE hospital and they of course falsified the report. That was a set up for there to be different medical reports.
