The woman who has accused three Duke University men's lacrosse players of raping her failed to identify at least one of them in a photo array eight days after the reported attack, according to a motion filed Friday by defense attorneys. The motion also says that she then selected him as an attacker more than two weeks later.

Is it known for certain that she did ID a 4th guy in the final lineup? If so, the fact that this idea of the 4th guy has been completely dropped by Nifong probably means that they figured out that fellow had a rock-solid alibi too.
There are no parallels in this case.

Paralleling that scenario, the rape should have occured at the ATM.

Two Arrested In Gang-Related Shooting Of A Bystander
DURHAM, N.C. -- A bystander was shot on Sunday during a shootout between two groups of people, Durham police said.
The victim, a 65 year-old woman, suffered two gunshot wounds -- one in each thigh, police said. She was transported to Duke University Hospital.
Two suspects, Christopher McNeill 19, and Jerome Carter, 18, were arrested after the shooting which is believed to be gang related, police said.
Police are looking for a third suspect in connection with the shooting.
The victim's name was not released by police.
There was an interesting study done a few years ago. Men were recruited to take part in a study of exercise and sexual arousal. One at a time they were put on an exercise bicycle and told to pedal as hard and as fast as they could for 15 minutes. As each one finished someone read the odometer reading. Half of them had the experimental condition: a VERY attractive woman in spandex came by, looked at the odometer, and in a VERY snotty way said something like,"Is that all you did? I did five more miles than you did."
After the exercise the men were shown pornography and uh, er, their arousal level was measured. The men who got insulted by the attractive girl got much more aroused by pornography with violence in which the women were overpowered. The other group didn't.
It seems some men, especially those who feel they've been wronged by women, probably would be into fanticizing about rape. They fanticize about being the aggressor. Women, on the other hand, might fanticize about being the victim and thus relieve themselves of responsibility.
McNeill - same name as the old Chief of Police in Durham. I wonder if it is a relative?

Yeah, probably not largely dominant in one sex or the other and more based on personality more than anything else.

Sure there are parallels with the Kobe case, just not the four you listed.
Small town, dirty police and politicians, dirty DA who is incompetent and using the case for political reasons since he's new to the job. Wendy Murphy and an army of middle-aged feminazis screaming GUILTY!!
It's MUCH like the Kobe case. The female acted voluntarily in both cases, lied in both cases, and was aided by a corrupt DA in both cases.
It's much more like the Kobe case than unlike it. Kobe wasn't guilty of anything except being stupid enough to (1) let the woman in his room, and (2) talk to the backwoods police officers who came to interrogate to him.

I could be wrong, but I was under the impression that the "4th
guy" was the 3rd guy with a moustache.
Evans, the third one indicted, was Image 5 in the line-up, Seligmann was Image 7, and Finnerty was Image 40. The unknown quasi-ID'd fourth guy was Image 4 in the line-up:

So, if the accuser was identifying 3.9 of the lacrosse players, and the .9 was the "90%" Evans, does that mean she was 100% certain of Image 4? If so, then why hasn't he been indicted? Is he turning for the DA?
As the transcript shows, Sgt. Gottlieb was curiously uninterested in her hit on the unknown Image 4. He didn't ask her degree of certainty about him. Early on, I read that two of the players (or their lawyers) presented proof that they weren't even in NC on the night of the party. Nifong declined to exclude them from the team testing. I think Image 4 was one of those two who Gottlieb knew wasn't at the party, much less one of the attackers.
A defense attorney, Cheshire I think, said to the press once that she had IDed someone who was not in Durham at the time. I like GAgal suspect that the first ID on the 4 of April was that person.
Now I know you might ask, not being in Durham is hardly reason for Nifong not to indict someone. But I guess they wanted the numbers to match as close a possible and 2.9 is closer to 3 than 3.9.
