Attorneys in Duke rape case file motion to get lineup report

The woman who has accused three Duke University men's lacrosse players of raping her failed to identify at least one of them in a photo array eight days after the reported attack, according to a motion filed Friday by defense attorneys. The motion also says that she then selected him as an attacker more than two weeks later.

Yes, of course.

I eagerly await Nifong's responding papers.

Nifong set the tone of non-communication with the defense early on by refusing to hear them out and view their exculpatory evidence. So now most everything is going to be done through court processes, opening the information up to public review, which is not a good position for the DA to have taken or to be in now. Further, the judge may tire of it and begin to sanction Nifong.

They lost power by showing their hypocrisy in failing to support the victims of President Bubbea's sexual proclivities, and are doing so again. Except for universities and certain urban enclaves, these women have little power or influence left. They aren't even able to raise the kind of money they used to raise.

That's why I've lost a lot of confidence in the whole thing. If they can stick a guy away for 22 years for political reasons, it's scary.

American blacks have had over a century to succeed, and lately forty years since the civil rights movement. No other group has been given the help, privileges, special considerations, money, exceptions and opportunities they have been given. Look at what they did with it. Yes, some have succeeded, but they also created a very sick culture of failure and mindset of victimhood in spite of those successes. So I agree with your point that other groups will fill the void created by the failures of black Americans to seize the day.

We know Kim Roberts was arrested on a months old probation violation on Mar. 22. I'm sure she told police she was the 911 caller then. So Nifong would have known that before Mar. 31.

I just heard some people interviewed in Durham on this case on the Radio.

Looks like they are focusing on the CIVIL case. Victoria Petersen was on the Radio and she said she's talked to lawyers in Durham and she's talked to the AV Family.

She said that the one of the people on the lease of the house was EVANS, she intimated that Evan's parents name was on the lease. She said that a 22 year old old invited the strippers and served alcohol to underage men in this same house. Mrs. Petersen said that the Evan's Mother - a lobbyist in Washington is going to be held financially responsible for the events that happened in that house that night. She mentioned the lower standard in the Civil court and she said the Washington Lawyer Father (that she connected to George Bush's White House) will have to pay for the actions of his son.
Again, she claimed to have spoken with many lawyers and were assured that the AV has a super strong case in civil court. Then she mentioned Duke's liability. She said Duke owned the house and had protected the unlawful players and looked the other way for years, allowing this to happen.
She said Duke would be a defendant in the Civil lawsuit also.

So, you can see where this case is going. The AV, and the black lawyers in her entourage are looking to get super Rich from this case. The Race angle will be used to exploit the jury and move the damages into the ionosphere.

Noticeably absent was the discussion of the CRIMINAL case: by the Durham women speaking.

The Asst. DA handling Evans' noise violation case is Ashley Cannon. It was postponed because she was going to be out of town.

The young women in this instance are not by any stretch of the imagination "feminists". They reacted to their less than warm reception by baiting those still at the party with strong words, got as good as they gave back, got drunk, violated the terms of their probations and didn't look beyond the expedient to get out of a jam. That isn't the M.O. of a feminist, that's the M.O. of someone who has been kicked to the curb and out on the streets. It's racism, it's payback, it's a lot of things, but these specific women are not "feminists". They are opportunists.

So, what is most likely a black-on-black crime is not a priority to Durham PD or the city politicians. Six months and no pressure to complete the testing. Instead, the police raid the house and seize pot processing equipment.

Strange thing about that case is that one of the victims, Lennis Harris, is the son of a Durham Fire Marshal and the nephew of a recently retired police captain, Sonny Harris, who headed the police district in which NCCU is located. I would think his family would have some influence in Durham. I guess not. Strange place.

That's the only place where we were lucky. Our son was charged as an adult, though still in high school. When the AV called to start negotiations, she was told that she would have to get blood from a turnip. My heart is bleeding for the Evanses. Sweet, Jesus, they have to stay the course and counter-sue.

Sgt. Shelton wrote in his report that Kim told him that night at Kroger she made the first 911 call. Nifong was lying to Abrams.

One sure way to continue the downward spiral of negative publicity for Durham is for the false accuser and her family to receive a windfall via her lies, enabled by a Durham jury of her peers - people of low character.

I'm sure that week, some NCCU students had someone dancing at a party somewhere in Durham, but no moral outrage, no investigation, no judgements, no prosecution, etc.

The Double standard is beyond outrageous.

That report from Shelton was written with the benefit of hindsight when it written belatedly. They didn't even know her name was Kim Roberts that night.

Shelton may have included things they became aware of later in his report (just like Robert's name).

Durham Police Spokesman Michael said in numerous press conferences that they didn't know the identity of the first 911 caller. They placed ads in the Durham papers and broadcast through locals news requests for the first 911 caller to come forward. Nifong believed the first call was independent corroboration of the wilding of the boys that night.

Double check on that.

File this one under "I told you so." I said a couple of weeks ago, after the outburst by Victoria Peterson at the Dave Evan's press conference, that the fall back position for all the race baiters is going to be "it's the boys fault, even if there was no rape."

Other 45 players go back to normal? .

And if they want to play lacrosse, maybe they go elsewhere, since Duke President Richard Brodhead and the rest of the big dogs haven't said yea or nay about fielding a team for the upcoming season. But there's also the notion of whether it'll do any good for the players to transfer if the curious stares will follow them wherever they go.

Yes, I noticed those facts in the article. One would think the family's involvement in public safety services would count for something. It usually does, especially since those agencies have authority in handling the matter - take care of their own, so to speak, which is okay with me. I don't object to the unity, but it seems to be absent in Durham.

The fact that Kim made the call was also mentioned in the collection of dispatch tape released.

Yes, Nifong lied, or had the information available and spoke before reviewing information he knew was available, which seems to be his M.O..
