Doesnt Terri Still Have a Subpoena To Attend Congressional Hearings on March 28?

While reading the latest updates on the case, I remembered that there are still these congressional hearings to be done next week.

If Terri was still alive Monday, could she be taken out of Judge Greer's jurisdiction by federal authorities to comply with the congressional order to testify? Maybe some of the more astute legal minds here could take this question on

Sad to say, you are correct. President Dwight Eisenhower had no problem sending federal troops to Little Rock to guarantee the safety of black students going to school, but here we are 48 years later and our federal government is reduced to making a bunch of fancy speeches, engaging in all sorts of impressive public displays of 'concern' about a helpless woman being murdered, and instead of troops, Washington sends a minor flurry of paper in the form of subpoenas, thinking that will do the job. Eisenhower would not have had to think twice to send in troops with orders to rescue Terri Schiavo, move her to the nearest military medical facility, and instruct the commander of that facility that Terri Schiavo was a ward of the United States Government until the Commander In Chief said otherwise, and she was to be kept safe, given all consideration and rehabilitation possible, and her would-be murderers would be banned from setting foot on government property.

had heard that the hearing scheduled for Friday was postponed but that the Monday ones might stil be on.

Today's hearing was scheduled by the House. The Schiavos were subpoenaed to appear before a House committee.

Monday's hearing is scheduled by the Senate. The Schiavos were asked to appear before a Senate committee.

The Good Friday's hearing had teeth, the Monday's hearing is voluntary. At least, that's the way I read this news article:

Officials announced that a House hearing set for Good Friday at Schiavo's Pinellas Park hospice was postponed. Schiavo and husband Michael had been subpoenaed to appear.

A Senate hearing on long-term care for the incapacitated, at which the Schiavos also were to be asked to appear, is still set for Monday in Washington.

DeLay Pledges Contempt Charge for Terri Judge

House Majority Leader Tom DeLay pledged Friday to hold Florida state judge George Greer in contempt of Congress for ignoring a congressional subpoena for Terri Schiavo's testimony, saying, "No little judge sitting in a state district court in Florida is going to usurp the authority of Congress."

"The Congress will pursue this, if we have to hold him in contempt of Congress," DeLay told radio host Sean Hannity.

Pressed on whether he intended to hold Judge Greer in contempt, the top Republican told Hannity: "Absolutely, absolutely."

"We will do everything to enforce the power and authority of the Congress and no little judge sitting in a state district court in Florida is going to usurp the authority of Congress," he added.

Probate judges in Pinellas County, Florida don't have to recognize Congressional subpoenas. Congress has no power in Pinellas County, King Greer rules there. Seriously though, Congress hasn't pursued this. Had they, Judge Greer should be brought to D.C. in chains.

I really hope the Congressional hearing isn't cancelled upon Terri's death, because if even half of what I've been reading is true, judge Greer and his cronies could very well end up in chains.

Particularly critical of the way that the Sixth Circuit Court judges handle guardianships is Robert W. Melton, chief deputy director internal audit division, certified public accountant, certified fraud examiner with the Pinellas County Circuit Court. During public hearings conducted by the Florida Guardian Task Force appointed by Florida legislators to address guardianship reform, Melton testified that in his office was being “stonewalled” in their attempts to audit guardianship [in Pinellas County]...

Melton told the task force that “In Pinellas County, attempts are being made to limit the clerk’s authority”, a county where George Greer is the Administrative Judge of the Probate Division...

Melton told the task force that the assets of wards are being transferred into pooled trusts that he says operate imprudently outside the supervision of the courts.  He adds that the real estate of wards is being sold at below-market prices to land trusts whose owners don’t have to be disclosed...

“When we have both guardians and judges trying to keep auditors out, we have a system ripe for corruption and fraud”, Melton said...

Former chief Judge F. Dennis Alvarez of the 13th Circuit, Hillsborough County, says that Pinellas County has historically resisted guardianship reform. Perhaps that’s because there’s big money to be made among lawyers and other players in guardianships---particularly in the disposition of assets of wards including real and personal property including real estate, jewelry and antiques in addition to the guardian fees.

Melton says that Pinellas judges, which include George Greer, not only keep court records hidden from public view but are anxious to extend the cloak of secrecy to the audits.  In February, 2004, Melton recommended to Chief Judge David Demers that he take a closer look at guardianships in the Sixth Circuit...

While conducting audits of guardianship reports, the Pinellas clerk’s office discovered serious irregularities...

...Greer has refused to appoint a new guardian ad litem [for Terri Schiavo], acting in the role himself---prohibited by Canon 3 of the state Code of Judicial Conduct.  No judge may serve as a guardian unless the ward is a member of his own family...

When complaints are made to law enforcement agencies such as in the Schiavo case, officials such as McCabe---with a prohibited conflict of interest with Greer, and former Sheriff Everett Rice who also had a prohibited conflict of interest with Greer as well as being a member of the board of directors of the Hospice Foundation of Florida Suncoast, a  subsidiary of the corporation operating the hospice where Terri Schiavo is a resident, claim it’s a civil matter being handled by the courts...

Politically connected attorneys who stand to profit handsomely from guardianship fees are involved with alleged guardianship abuse.  In Greer’s 2004 reelection campaign, a massive $144,000 was raised in campaign contributions, said to be the largest amount ever raised in a judicial campaign.  More than half of those contributors were attorneys----attorneys whose practices in real estate, probate, wills and elder law stand to profit greatly from guardianships to which they are court appointed by probate judges such as George W. Greer.

Reportedly euthanized at an animal shelter.

By statute, and SCOTUS decision, Florida has not more than two methods of execution, and currently maybe only one -- lethal injection. Electric chair may have been ruled too cruel and inhumane a method. In so many ways, what's been ordered for Terri is a total unlawful and unconstitutional travesty.

There will be no contempt charge. I have to sadly say that I am beginning to side with those who say that our side folded and went away with its tale between its legs.


There was no reason to cancel the hearing at the hospice. The judge might have been able to (illegally) quash the subpoena to Terri but they could not have stopped the subpoena to Michael. If Michael had been called and grilled the whole world could have seen what a cad he is and perhaps the pressures on the politicians would have made it more likely they would have act.

No, I'm sure he'll ask a judge if he can do his job first. If the judge says no, Jeb will have to go to his room.

If the Schindlers filed murder charges against Michael Schiavo they might have no choice but to examine the body and perform an autopsy.

Unfortunately, JINO Greer did both in accomodation of HINO's legal request. So the feeding tube was surgically removed AND Greer's order to withhold all food and water is being followed.

Yes, and you are 100% correct on POINT 2. Unfortunately the majority of MSM mislead Americans haven't a clue about that difference. So that's is why a number of polls show that about 2/3rds of Americans side with HINO on pulling Terri's gastronomic tube.

Schindlers filed murder charges Private citizens don't file charges, that would have be done by a county attorney or other official, I believe.

Right. There will be NO investigation of Judge Greer for this. If Jeb refuses to stand up to the Judge for Terri while she is alive and rescue her, he is not going to do it after she expires.

I believe his ruling was that no one could remove her from the hospice or he/she/they would be in contempt of court -- his ruling. So everyone backed off.
This county court judge has Florida's entire governmental structure under his thumb, and also Congress and POTUS, with the federal judiciary, up to SCOTUS, circling the wagons to uphold his rulings. [sarcasm] Where's the recent SCOTUS' new philosophy to take other nations' court philosophies into account? [end sarcasm]. Quite a few of them lean more decisively toward preservation of life than what's being inflicted on innocent, defenseless Terri.

Judge Greer will instantly dismiss the murder charge and quash any attempt by the executive branch to investigate the situation.
