It may have been dark and all the kids could see was their father on top of their mother. He had abused her in the past and they thought it was happening again.

At the risk of getting way too personal, I have been in a similar situation. Of course I didn't shoot my step-father, but one night when my mother and he were being intimate and got loud, my sisters and I thought that he was beating her again. My sister went into their bedroom with a skateboard raised over her head and I was behind her. We figured out what was going on rather quickly and left the room. But our past experiences had led us to the point where we were ready to do whatever was necessary to protect our mother. We were 12 and 11 at the time. If it had been dark in the room, we may very well have jumped on my step-father simply because we didn't want to hear our mother cry again.

Sheriff's deputies charged the boy with aggravated assault with a deadly weapon, a first-degree felony.

In light of the details regarding the father's previous convictions, this is the most outrageous thing I have read all day. If all facts are on the table and no other details emerge, the child should not be charged. Period.
