I have sentenced thousands of defendants to state prison. I have NEVER demanded as a condition of probation that they confess their guilt after a jury verdict where they pled not guilty. Maintaining one’s innocence is not the same as showing a lack of remorse.

Here, there should be a presumption that probation is appropriate. Trump has no criminal record and this is the lowest class felony. But he will have to accept the terms of probation, and one of which is to regularly report to his probation officer in New York. He could be ordered not to leave NY with out the probationer officer’s consent. They could make it so that he couldn’t campaign. He may then opt to refuse probation, take a prison sentence, and get bail on appeal.

I hope all this blows up in the democrats’ collective faces.

Or he could stay in NYC and do virtual rallies. He could milk the sentence for several million votes.

In your opinion, do most probation officers lean right or left?

Are officers chosen at random or can they be specially appointed?
